RESOLUTION NO. 2002-581
REIMBURSING DEVELOPER FOR
CONSTRUCTION OF PUBLIC IMPROVEMENTS
SEVEN GREENS (2001031)
WHEREAS, the City of Plymouth and Swan Development, LLC have entered into a
development contract dated September 26, 2001 for the plat Seven Greens (2001031); and
WHEREAS, as part of this development, the developer was required to constrict public
improvements including the public watermain within the Vicksburg Lane right-of-way and
the bituminous trails along Schmidt Lake Road and Vicksburg Lane; and
WHEREAS, the City is responsible for incremental cost of the public improvements above
that which is the responsibility of the developer under the City Assessment Policy; and
WHEREAS, Swan Development's engineer has certified that the work to date complies with
the approved plans and specifications; and
WHEREAS, the Vicksburg Lane watermain system was accepted for continual maintenance
at the November 26, 2002 City Council meeting; and
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the developer, Swan Development, LLC, is
to be reimbursed in the amount of $132,745.10 for the constriction of the public
improvements including trunk watermain within the Vicksburg Lane right-of-way and the
bituminous trail along Schmidt Lake Road and Vicksburg Lane in accordance with the
development contract and City Policy.
BE IT FURTHER RESOLVED that $101,785.10 of the funds be allocated from the City's
Trunk Utility fiend, and the remaining $30,960.00 be allocated from the Neighborhood Parks
Dedication fiend.
