HomeMy WebLinkAboutCity Council Resolution 2002-571CITY OF PLYMOUTH RESOLUTION NO. 2002-571 ORDERING PUBLIC HEARING ON THE VACATION OF PART OF A PERMANENT EASEMENT FOR PUBLIC UTILITY PURPOSES AND A TEMPORARY EASEMENT IN THE SOUTH 127.50 FEET OF LOT 16 WAYZATA FARMSTEADS WHEREAS, pursuant to M.S.A. 412.851 and the City Charter Section 12.06, Theodore Kemna of Schoell & Madson, Inc., has petitioned the City Council for the vacation of the following permanent easement for public utility purposes and a temporary easement: Description of Parcel: The south 125.70 feet of Lot 16, "Wayzata Farmsteads," according to the recorded plat thereof, Hennepin County, Minnesota, as measured at right angles to and parallel with the south line of said Lot 16. Easement to be Vacated: That particular 20.00 foot public utility easement as granted in Document No. 5056992 and described as follows: A permanent easement, 20 feet in width for public utility purposes and a temporary easement, 100 feet in width for constriction purposes, over, under, across, and through part of the above described parcel, the centerline of both which is described as follows: Commencing at the southeast corner of said Lot 16, thence westerly along the south line of said Lot 16 a distance of 304.50 feet, thence deflecting northerly to right 90 degrees 00 minutes 00 seconds, a distance of 125.70 feet, thence northwesterly to a point of the west line of said Lot 16, distant 250.70 feet North of the southwest corner of said Lot 16, and said centerline there terminating. AND WHEREAS, the City Council has reviewed said request and found the same to be in order; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That it should, and hereby does, establish the date of January 28, 2003 at 7:00 p.m. in the Council Chambers, Plymouth City Center, 3400 Plymouth Boulevard, as the time and place for the public hearing of said petition and directs the administrative staff to publish notice of said hearing as provided by law. Adopted by the City Council on December 17, 2002.
