RESOLUTION 2002-544
REVISING RESOLUTION 2002-506 APPROVING A FINAL PLAT AND DEVELOPMENT
CONTRACT FOR ORRIN THOMPSON HOMES FOR PHASE I OF "TIMBER CREEK
CROSSING" LOCATED AT SCHMIDT LAKE ROAD AND GARLAND LANE (2001114F)
WHEREAS, Orrin Thompson Homes has requested approval of a final plat and development
contract for Phase I of Timber Creek Crossing", a plat with 54 row -townhouse lots, five lots to
accommodate 236 back-to-back townhouse units, four common open -space lots and three
outlots on 36.46 acres located north and west of the Canadian Pacific Railroad and north of fiiture
Schmidt Lake Road; and
WHEREAS, the property is legally described as follows:
That part of the southeast quarter of the northwest quarter of Section 8, Township 118
North, Range 22 west of the 5"' Principal Meridian, lying northwesterly of the
northwesterly right-of-way line of the Soo Line Railroad.
That part of the southwest quarter of the northeast quarter of Section 8, Township 118
North, Range 22 west of the 5"' Principal Meridian, lying northwesterly of the
northwesterly right-of-way line of the Soo Line Railroad.
WHEREAS, the City staff has prepared a development contract covering the improvements
related to said plat.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve a replacement
resolution for Orrin Thompson Homes for a final plat for Timber Creek Crossing, and,
FURTHER, that the development contract for said plat be approved, and that the Mayor and City
Manager be authorized to execute the development contract on behalf of the City; and,

FURTHER, that the following conditions be met prior to recording of, and related to said plat:
1. This final plat approves 54 row -townhouse lots, five lots to accommodate 236 back-to-back
townhouse units, four common open -space lots and three outlots, in accordance with the
plans received by the City on October 3, 2002 and August 8, 2002, except as amended by this
Resolution.
2. Prior to recording the final plat, the applicant shall submit a revised final plat which merges
Outlot B, Block 4 into Lot 2, Block 4.
3. Prior to recording the final plat, the applicant shall submit the required utility and drainage
easements as approved by the City Engineer.
4. Prior to recording the final plat, the applicant shall submit the required easements for the trail
along Schmidt Lake Road and Dunkirk Lane.
5. Prior to recording the final plat, a pond maintenance agreement is required between the
developer and the City for the water quality pond.
6. Prior to recording the final plat, the developer shall pay the park dedication fees, pursuant to
the Dedication Policy in effect at the time of recording the final plat, for the total number of
units shown on the plans.
7. With the application materials for Phase II, the applicant shall provide plans showing the
watermain looped and connected to the watermain on Comstock Lane and Schmidt Lake
Road.
8. Prior to the issuance of any building permits, signs shall be posted in the following locations
notifying residents of the following items:
a. Located on the end of public road C on or near the Gun Club property advising potential
property owners of the existence of the gun club, its hours of operation (which are subject
to change) and that repetitive, loud noise is produced during those hours. This sign shall
remain in place as long as the Gun Club is in operation.
b. At the farthest finished extent of Dunkirk Lane alerting residents to the temporary nature
of the cul-de-sac.
9. Prior to the issuance of any building permits, the applicant shall submit plans showing the
additional building materials and how they reduce the impact of the Gun Club and the
Railroad on the adjacent units.
10. Prior to the issuance of any building permits, the applicant shall submit revised floor plans
illustrating the maximum size of the third story with no more than 500 total square feet.

11. The applicant is encouraged to incorporate additional sidewalks along the public streets
leading to Dunkirk Lane.
12. The applicant is encouraged to work with staff to meet the gap financing of qualified buyers
for the affordable units.
13. All constriction traffic shall enter the site from Schmidt Lake Road. No access shall be
permitted via the existing unpaved, Dunkirk Lane.
14. Development standards shall be as required by the RMF -2 district with the exception of the
variance granted with the site plan approvals for Lot 3, Block 1.
15. The HOA shall be responsible for maintenance of sidewalks, boulevard plantings, wetland
buffers, mailboxes, monument signs and association common areas within this development.
The HOA documents shall include language to address maintenance of these features.
16. The applicant shall be responsible for constricting the trail along Schmidt Lake Road and
Dunkirk Lane for the entire project. Financial guarantees for the completion of this item shall
be included in the development contract.
17. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Removal of all hazardous trees from the property at the owner's expense.
c. No building permits shall be issued until a contract has been awarded for sewer and water
d. No building permits, with the exception of a model unit, shall be issued until the final plat,
easements, maintenance agreements, and HOA documents are filed and recorded with
Hennepin County and proof of recording is received by the City.
e. No building permits shall be issued until the Site Improvement Performance Agreement
has been executed and the required financial guarantees submitted.
f. Street names shall comply with the City Street Naming System.
g. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release
or reduction of any site improvement financial guarantees per City Policy.
h. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
strictures on sites adjacent to, or containing any open storm water drainage facility.
