RESOLUTION NO. 2002-542
REQUEST FOR PAYMENT NO. 3 AND FINAL
PLYMOUTH BOULEVARD PARKING BAY
AND OVERLAY IMPROVEMENTS
CITY PROJECT NO. 1002
WHEREAS, the City of Plymouth as owner and DMJ Corporation as contractor, have
entered into an agreement for Plymouth Boulevard Parking Bay and Overlay
Improvements project, City Project No. 1002, said agreement was approved by the City
Council on August 28, 2001; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $302,995.85. No change orders
were approved and the value of the work to date is $287,074.40 and is
herewith approved. This project does not exceed the approved contract
amount.
2. That the work performed by the contractor for Plymouth Boulevard
Parking Bay and Overlay Improvements project and certified to the
Council by the engineer as acceptable, being the same, is hereby released
from the contract except as to the conditions of the performance bond, any
and all legal rights of the owner, required guarantees and correction of
faulty work after final payment.
3. Request for Payment No. 3 and Final in the amount of $17,229.18 (CP No.
1002) to DMJ Corporation for Plymouth Boulevard Parking Bay and
Overlay Improvements project is hereby approved and the City Finance
Director is hereby authorized and directed to pay the same forthwith.
