HomeMy WebLinkAboutCity Council Resolution 2002-531CITY OF PLYMOUTH RESOLUTION 2002-531 APPROVING A CONDITIONAL USE PERMIT TO ALLOW INSTALLATION OF A 75 -FOOT MONOPOLE WITH TELECOMM[_]NICATION ANTENNAS AND RELATED EQUIPMENT FOR MIDWEST REAL ESTATE SERVICES, INC. AT OAKWOOD SQUARE SHOPPING CENTER, 1400 COUNTY ROAD 101. (2002130) WHEREAS, Midwest Real Estate Services, Inc. has requested approval of a conditional use permit for a 75 -foot high monopole tower to be located on the following described property: Lot 3, Block 1, Oakwood Square WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Midwest Real Estate Services, Inc. for a conditional use permit at Oakwood Square Shopping Center, subject to the following conditions: 1. A conditional use permit is approved to allow a 75 -foot high monopole tower with antennas and the related equipment, pursuant to the plans received by the City on September 25, 2002 with the findings that the proposal would comply with all the general standards, specifically installation of the monopole 1) would be consistent with the Comprehensive Plan; 2) would not be detrimental to the public health, safety, morals or comfort; 3) would not be injurious to the use and enjoyment of other property in the area nor substantially diminish or impair property values within the neighborhood; 4) would not impede the development or improvement of surrounding properties; and 5) would comply with the standards outlined in the Zoning Ordinance. Lights shall be installed at a height no greater than the existing lights, shall be consistent with the existing design, and shall be in conformance with Section 21105.06. 3. The project requires a separate building permit prior to installation of the tower and equipment. 4. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 5. The PVC and coaxil cable shall be installed using directional boring. In no circumstances shall the items be installed using a trench. 6. The monopole shall be painted a non -contrasting color or have a galvanized finish. 7. The conditional use permit shall expire one year from the date of approval, unless the project is substantially completed or an extension is applied for and granted, as regulated under Sections 21015.07 of the Zoning Ordinance.
