RESOLUTION 2002-528
APPROVING SITE PLAN AMENDMENT AND CONDITIONAL USE PERMIT TO
ALLOW A 66 -FOOT BY 104 -FOOT ACCESSORY BUILDING TO BE LOCATED
SOUTH OF THE ICE ARENA AT CENTRAL MIDDLE SCHOOL, 305 VICKSBURG
LANE NORTH (2002107)
WHEREAS, Wayzata Public Schools has requested approval of a site plan amendment and
conditional use permit for property legally described as follows;
The southeast quarter of the southeast quarter, the south 535.4 feet of the northeast quarter of the
southeast quarter, and the south 535.4 feet of the east 10 acres of Government Lot 7, all in
Section 32, Township 118 North, Range 22, subject to all easements of record for road purposes
over the strip of Land 1 rod wide North of the south line of said above described southeast
quarter of southeast quarter of Section 32, Township 118 North, Range 22, and subject to all
public roadways now existing on said property; to wit; a town road over the east 33 feet of the
southeast quarter of Section 32, Township 118 North, Range 22, and County Road 15.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Wayzata
Public Schools for a site plan amendment and conditional use permit, subject to the following
conditions:
1. A site plan amendment and conditional use permit are approved for a 66 -foot by 104 -foot
accessory building located south of the ice arena, according to the plans and application
received by the City on August 9, 2002 and revised plans received on October 16, 2002
except as amended by this resolution.

2. A building permit is required prior to constriction of the accessory building.
3. The proposed accessory building must be protected with a City approved automatic fire
sprinkler system.
4. Standard Conditions:
a. Submission of the required Financial Guarantee and Site Performance Agreement for
completion of site improvements prior to issuance of building permits.
b. Compliance with the Ordinance regarding operation of the watermain and the location of
hydrants, post indicator valve, fire department connection, and a fire department lockbox
shall be provided.
c. Prior to the issuance of utility or building permits, fire flow calculations shall be in
compliance with City Code/Uniform Fire Code.
d. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release
or reduction of any site improvement financial guarantee per City Policy.
e. This approval shall expire one year after the date of approval, unless the property owner
or applicant has substantially started constriction of the project, or unless the landowner
or applicant has received prior approval from the City to extend the expiration date for up
to one additional year, as regulated under Sections 21015.07 and 21045.09 of the Zoning
Ordinance.
