HomeMy WebLinkAboutCity Council Resolution 2015-171 CP ITY OF LYMOUTH RN.2015-171 ESOLUTION O RAPUDA,PFP ESOLUTION PPROVING A MENDMENT AND RELIMINARY AND INAL LAT FOR ODC,LLC,PPBC PUS EVELOPMENT OMPANY FOR LYMOUTH OINT USINESS ENTER SC25ANL TH TO BE LOCATED AT THE OUTHWEST ORNER OF VENUE AND IAGARA ANE (2015025) WHEREAS, Opus Development Company, LLC, has requested approval of a PUD amendment and preliminary and final plat to allow construction of a 96,500 square foot office/warehouse building in the vacant north portion of the Daily Printing site located at 2333 Niagara Lane; and WHEREAS, the affected property is presently legally described as Lot 1, Block 1, Parkers Lake th Corporate Center 5 Addition, Hennepin County, Minnesota; and WHEREAS, the affected property would be legally described as Lots 1 and 2, Block 1, Parkers Lake th Corporate Center 11 Addition, Hennepin County, Minnesota, upon recording of the final plat (Lot 1 is the location of the proposed building in the north portion of the site, and Lot 2 is the location of the existing Daily Printing building in the south portion of the site); and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Opus Development Company, LLC, for a PUD amendment, and preliminary and final plat for a new office/warehouse building, subject to the following conditions: 1.A PUD amendment and related development standards are approved to allow construction of a 96,500 square foot office/warehouse building on proposed Lot 1, in accordance with the plans received by the city on May 12, 2015, except as may be amended by this resolution. 2.A preliminary and final plat is approved in accordance with the plat drawings received by the city on May 12, 2015. 3.Approval of the site plan is contingent upon final determination by city staff, Hennepin County, and the Board of Water and Soil Resources that a small swale located in the east portion of the site is an incidental wetland. 4.Office use for proposed Lot 1 is limited to a maximum of 47 percent of the gross floor area of the building. 5.The uses allowed on proposed Lot 1 shall include all uses presently allowed as permitted, accessory, conditional, interim, and administrative in the I-2 district. Resolution 2015-171 File 2015025 Page 2 6.Prior to recording the final plat, the applicant shall pay any and all deferred assessments related to the property. 7.A separate building permit is required prior to commencement of the project. 8.Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a.Record the final plat. b.Obtain city approval of final construction plans. c.Complete a site improvement performance agreement and submit the related financial guarantee pursuant to section 21045.10 of the zoning ordinance. d.Obtain NPDES permit and any required permits from the watershed district and Army Corps of Engineers. e.A maintenance agreement is required for the filtration basin. f.A cross-easement agreement is required for fire access and water supply between the two lots within this proposed plat. 9.Silt fence and tree protection fencing shall be installed prior to any grading or construction on the site. 10.Fire lane signage shall be provided in locations to be field identified by the fire inspector. 11.PUD flexibility is hereby granted to allow existing drive aisles on proposed Lot 2 to remain in their present locations (less than 15 feet from the lot line that separates proposed Lots 1 and 2), as shown on the plans received by the city on May 12, 2015. 12.Standard Conditions: a.No trees may be planted in the public right-of-way. b.Any rooftop equipment shall be painted or screened to match the building. c.Compliance with the city’s lighting regulations. d.Any signage shall comply with the PUD and with section 21155.06, Subd. 6 (signage for industrial districts) of the zoning ordinance, and shall receive sign permits if required. e.Park dedication for this site has been previously satisfied. f.Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. g.The final plat shall expire two years after the date of approval, unless the property owner or applicant has recorded the plat, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of the City Code. th ADOPTED by the Plymouth City Council this 9 day of June, 2015.
