HomeMy WebLinkAboutCity Council Resolution 2015-169 CP ITY OF LYMOUTH RN.2015-169 ESOLUTION O RAVPDU ESOLUTION PPROVING THE ACATION OF A ORTION OF A RAINAGE AND TILITY EL3,B6SG ASEMENT IN OT LOCK EVEN REENS WHEREAS, a public hearing with respect to said vacation was scheduled for June 9, 2015, in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of June 9,2015 ; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on June 9, 2015 to inform any and all interested parties relevant to the vacation of a portion of an easement for drainage and utility purposes in Lot 3, Block 6, Seven Greens ; and WHEREAS, it was determined by the City Council that said easement was not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the following drainage and utility easement be vacated: Drainage and utility easement over, under and across that part of Lot 3, Block 6, Seven Greens, Hennepin County, Minnesota, described as follows: Commencing at the northeasterly corner of Lot 3, Block 6, Seven Greens; thence southwesterly along the northwesterly line of said Lot 3, Block 6, a distance of 122.22 feet to Point “A” and the actual point of beginning of the easement to be described; thence continuing southwesterly along the northwesterly line of said lot 3 a distance of 3.34 feet to the northwesterly corner of said Lot 3; thence southwesterly along the northwesterly line of said Lot 3 a distance of 65.51 feet to the southwesterly corner of said Lot 3; thence southeasterly along the southwesterly line of said Lot 3 a distance of 36.08 feet; thence northerly to Point “A“ and the northwesterly line of said Lot 3 and there terminating. EXCEPTING therefrom the northerly 10 feet, the northwesterly 6 feet and the southwesterly 6 feet and they shall be retained by the city. FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
