HomeMy WebLinkAboutCity Council Resolution 2002-511CITY OF PLYMOUTH RESOLUTION NO. 2002-511 ORDERING PUBLIC HEARING ON THE VACATION OF A PERPETUAL SANITARY SEWER EASEMENT PAULASPLACE WHEREAS, pursuant to M.S.A. 412.851 and the City Charter Section 12.06, Earl Fischer has petitioned the City Council for the vacation of a perpetual sanitary sewer easement recorded under Document Number 3999293: DESCRIPTION OF PARCEL: Part of the East Half of the Northeast Quarter of Section 30, Township 118, Range 22, Hennepin County, Minnesota, described as follows. Commencing at the Southeast corner of Sunny Acres, according to the recorded plat thereof, thence on an assumed bearing of South 88 degrees 20 minutes 44 seconds West, along the South line of said Sunny Acres 450.00 feet to the point of beginning; thence South 12 degrees 20 minutes 44 seconds West 672.62 feet to the centerline of Hennepin County Road 101; thence Northwesterly along said centerline to the intersection of line bearing South 88 degrees 20 minutes 44 seconds West from the point of beginning, thence N 88° 20'44" E, to the P.O.B. except that part acquired by the State of Minnesota for highway purposes, as set forth in Final Certificate filed as Document No. 5146199. DESCRIPTION OF EASEMENT: A perpetual sanitary sewer easement over that part of the above described parcel: Lying within a 20 foot strip of land the centerline of which is described as follows: Commencing at the Southwest corner of Lot 1, Block 1, Snyder's Pine Ridge; thence Northerly along the Westerly line of said Lot 1, a distance of 125 feet to the point of beginning of the line to be described; thence Easterly, deflecting to the right 96°, a distance of 100 feet; thence Northeasterly, deflecting to the left 44° 22' 02", a distance of 81.34 feet; thence Northeasterly, deflecting to the left 19° 33' 25", a distance of 297.34 feet; thence Northerly, deflecting to the left 10° 02' V, a distance of 205.88 feet; thence Northerly, deflecting to the left 23° 20' 14", a distance of 251.88 feet; thence Northeasterly, deflecting to the right 41° 29' 43", a distance of 471.88 feet to a point on the Southerly line of Lot 7, Block 4, Sunny Acres, distant 61.71 feet Westerly of the Southeast corner of said Lot 7 and there terminating. Also, a perpetual sanitary sewer easement over the East 185.0 feet of the North 30.0 feet of the above described property. AND WHEREAS, the City Council has reviewed said request and found the same to be in order; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That it should, and hereby does, establish the date of December 17, 2002 at 7:00 p.m. in the Council Chambers, Plymouth City Center, 3400 Plymouth Boulevard, as the time and place for the public hearing of said petition and directs the administrative staff to publish notice of said hearing as provided by law. Adopted by the City Council on November 12, 2002.
