HomeMy WebLinkAboutCity Council Resolution 2002-503CITY OF PLYMOUTH RESOLUTION 2002-503 APPROVING PRELIMINARY AND FINAL PLAT FOR MARK SCHERER, FOR 2 SINGLE FAMILY LOTS TO BE CALLED "SCHERER BASSLAKE", FOR PROPERTY LOCATED AT 12001 COUNTY ROAD 10 (2002120) WHEREAS, Mark Scherer has requested approval of a preliminary and final plat for 2 single family lots on a 3.4 -acre site located at 12001 County Road 10; and WHEREAS, the property is legally described as: That part of the west 285.38 feet of the east 471.66 feet Government Lot 4, Section 2, Township 118, Range 22, west of the 5"' Principal Meridian which lies southerly of the centerline of Bass Lake Road. Subject to an easement for public right-of-way purpose over the northerly 33.00 feet of the above described property. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Mark Scherer for approval of a preliminary and final plat for 2 lots on a 3.4 -acre site located at 12001 County Road 10, subject to the following conditions: 1. The preliminary and final plat are approved in accordance with the plans received by the City on October 14, 2002, except as amended by this Resolution. 2. The applicant shall comply with the tree preservation regulations outlined in the City Code. Resolution 2002-503 (2002120) Page 2 3. Prior to recording the final plat, the developer shall pay the park dedication fees in lieu of land dedication for one lot, pursuant to the Dedication Policy in effect at the time of recording the final plat. 4. No direct access shall be allowed to County Road 10. 5. Setbacks shall be as required for the RSF-1 district. No variances are approved or implied. 6. A building permit shall be required for the constriction of the home on Lot 1. 7. All requirements of the Bass Lake Shoreland Management Overlay district shall apply to both lots. No variances are approved or implied. 8. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. d. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. ADOPTED by the City Council on November 12, 2002 STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
