RESOLUTION 2002-501
APPROVING A CONDITIONAL USE PERMIT FOR ELM CREEK GOLF FOR
PROPERTY LOCATED AT 19010 STATE HIGHWAY 55 (2002075)
WHEREAS, Elm Creek Golf has requested approval of a conditional use permit to allow
more than one principal building on a site to allow an existing home and clubhouse to
remain during constriction of a new clubhouse, for property legally described as follows:
That part of the west half of the northwest quarter of Section 7, Township 118, Range 22,
Hennepin County, Minnesota described as follows: Beginning at the northwest corner of
said Northwest Quarter; thence on an assumed bearing of South 00 degrees 32 minutes 35
seconds West, along the west line of said Northwest Quarter, a distance of 50.00 feet;
thence South 89 degrees 59 minutes 18 seconds East a distance of 427.26 feet; thence
South 42 degrees 00 minutes 42 seconds West a distance of 569.68 feet; thence South 00
degrees 32 minutes 35 seconds West a distance of 198.62 feet; thence South 89 degrees
51 minutes 45 seconds East a distance of 260.00 feet; thence North 57 degrees 00 minutes
42 seconds East a distance of 740.84 feet; thence South 68 degrees 02 minutes 07 seconds
East a distance of 78.86 feet; thence South 18 degrees 00 minutes 42 seconds West a
distance of 434.48 feet; thence South 06 degrees 00 minutes 42 seconds West a distance
of 518.73 feet; thence South 21 degrees 00 minutes 42 seconds West a distance of 128.09
feet to an intersection with the south line of said Northwest Quarter of said Northwest
Quarter; thence North 89 degrees 43 minutes 56 seconds West, along said south line, a
distance of 289.79 feet to a point on said line distance 486.51 feet east of the northwest
corner of the Southwest Quarter of said Northwest Quarter; thence South 84 degrees 11
minutes 06 seconds West a distance of 256.35 feet; thence South 32 degrees 10 minutes
13 seconds West a distance of 286.42 feet; thence South 12 degrees 00 minutes 34
seconds West a distance of 410.15 feet to the southwest corner of the North Half of said
Southwest Quarter of the Northwest Quarter; thence south along the west line of said
West Half of the Northwest Quarter to the southwest corner of said West Half of the
Northwest Quarter; thence east along the south line of said West Half of the Northwest
Quarter to the southeast corner of said West Half of the Northwest Quarter; thence north

That part of the West Half of the Northeast Quarter of the Southwest Quarter of Section
7, Township 118 North, Range 22 West, of the 5"' Principal Meridian, lying northerly of
the northerly line of the Minneapolis, St. Paul and Sault Saint Marie Railroad (Canadian
Pacific Railway).
And,
That part of the Northwest Quarter of the Southwest Quarter of Section 7, Township 118,
North Range 22 West of the Fifth Principal Meridian described as follows, to wit:
Beginning at the Northeast corner of said Northwest Quarter of the Southwest Quarter;
thence West along the North line of said Tract to the Northwest corner thereof, thence

Section 7 to the South line of State Think Highway No. 55; thence southeasterly along
said South line to its intersection with the North line of the right-of-way of the

said West line to the South line of the right-of-way of the Minneapolis, St. Paul and Sault
Ste. Marie Railway; thence East along the South line of said railway right-of-way to the
Westerly line of the State Highway No. 55; thence Southeasterly along the West line of
said State Highway No. 55 to the North line of the Rockford Road; thence Southeasterly
along the North line of said Rockford Road to the South line of the Northwest Quarter of
the Southwest Quarter of Section 7; thence East along the South line thereof to a point
370 feet West of the Southeast corner of said tract; thence North parallel with the East
line of said Northwest Quarter of Southwest Quarter to the north line of said State Think
Highway No. 55; thence northwesterly along said north lien to a point 548 feet west of the
East line of said Northwest Quarter of the Southwest Quarter measured parallel with the
South line of said Northwest Quarter of the Southwest Quarter; thence North parallel with
the East line of said Northwest Quarter of Southwest to the south line of the right-of-way
of the Minneapolis, St. Paul and Sault Ste. Marie Railway; thence easterly along the south
line of said railway to the East line of the Northwest Quarter of the Southwest Quarter of
Section 7; thence North along the East line of said tract to the point of beginning, except
railway right-of-way; and except that part described as follows: Beginning at a point
which point is 123.7 feet South of the West Quarter corner of said Section 7, thence
South 200 feet to the intersection of the West line of said Section 7 and the northerly line
of State Highway Number 55; thence Southeasterly along said Northerly line of said State
Highway Number 55, 399.4 feet; thence Northeasterly along the extension of the radius of
the last described course 92 feet thence North and parallel to the West line of said Section

7, 250 feet; thence at an angle of 71 degrees 21 minutes left a distance of 402.6 feet to
point of beginning, and except that part thereof embraced in Registered Land Survey No.
133, Files of Registrar of Titles, County of Hennepin.
And,
That part of the Northwest Quarter of the Southwest Quarter of Section 7, Township 118
North, Range 22 West described as follows: Beginning at a point which point is 123.7
feet South of the West Quarter corner of said Section 7; thence South 200 feet to the
intersection of the West line of said Section 7 and the Northerly line of State Highway 55;
thence Southeasterly along said Northerly line of said State Highway Number 55, 399.4
feet; thence Northeasterly along the extension of the radius of the last described course 92
feet; thence North and parallel to the West line of said Section 7, 250 feet; thence at an
angle of 71 degrees 21 minutes left a distance of 402.6 feet to point of beginning.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Elm Creek Golf for a conditional use permit for property located at 19010
State Highway 55, subject to the following conditions:
1. This conditional use permit is approved to allow more than one principal building on a
site to allow an existing home and clubhouse building to remain during constriction of
a new clubhouse, in accordance with the application received by the City on October
15, 2002, except as amended by this resolution.
2. This approval requires complete removal of the existing home before March 15, 2003.
If the home is not removed by March 15, 2003, the City will discontinue to schedule
inspections for the new clubhouse and all work on the new clubhouse shall cease until
the existing home is removed.
3. This approval requires complete removal of the existing clubhouse, or conversion of
that stricture into an accessory stricture that complies with all applicable codes and
ordinances, prior to issuance of the certificate of occupancy for the new clubhouse.
4. This approval requires abandonment of the septic system for the existing home prior to
issuance of the certificate of occupancy for the new clubhouse.

5. Non-compliance with the terms of this conditional use permit may result in revocation
of this permit.
6. This approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started constriction of the project, or unless the
landowner or applicant has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Section 21015.07 of
the Zoning Ordinance.
