HomeMy WebLinkAboutCity Council Resolution 2002-474CITY OF PLYMOUTH RESOLUTION 2002-474 APPROVING A VARIANCE FOR JOSEPH SCHEITLIN FOR PROPERTY LOCATED AT 2825 EVERGREEN LANE NORTH (2002117) WHEREAS, an application has been filed by Joseph Scheitlin which requests approval of a variance for an 8.75 -foot setback from a street and utility easement for an addition for property legally described as follows: That part of Tract H lying east of the west 231.50 feet of said Tract H, except that part lying east of the westerly line of Tract L, Registered Land Survey No. 237, extended northerly to the shore of Medicine Lake, Registered Land Survey No. 237, Files of Registrar of Titles, County of Hennepin, subject to a permanent easement for a street and utility purposes as per Document No. 1093916. Tract I, except the west 231.50 feet, Registered Land Survey No. 237, Files of Registrar of Titles, County of Hennepin, subject to a permanent easement for street and utility purposes as per Document No. 1093916. Tract J, except the west 231.50 feet, Registered Land Survey No. 237, Files of Registrar of Titles, County of Hennepin, subject to a permanent easement for street and utility purposes as per Document No. 1093916. WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the variance request for an 8.75 -foot setback from a street and utility easement for an addition for property located at 2825 Evergreen Lane North, subject to the following findings and conditions: Resolution 2002-474 (2002117) Page 2 1. This variance request to permit an 8.75 -foot setback from a street and utility easement is hereby approved in accordance with the application and plans received by the City on August 27, 2002, and additional information on September 9, 2002, except as amended by this resolution. 2. The addition shall be finished to match the existing home. 3. This resolution is approved with the finding that the applicable variance standards have been met. Specifically: a) The parcel is a riparian lot on Medicine Lake. This restricts the amount of impervious surface that can be placed on the lot. The proposed addition toward Evergreen Lane would minimize the increase in impervious surface coverage, being the existing driveway can be used for access to the new garage. It is also the most logical location for expansion from an architectural standpoint and provides an opportunity for modest expansion to increase the livability of the home. b) The conditions of the parcel are unique due to the unique architecture of the home and the placement of the home on the lot and the lake in the rear yard. The proposed addition must be placed at the proposed angle to match the existing roof line, to keep the bedrooms on the second floor together, to enclose the entry to the house on the second floor, and to use the existing driveway. c) The request is not based exclusively upon a desire to increase value or income potential of the property. The proposed addition would allow the applicant to increase the livability of the home and provide additional space to accommodate a growing family. d) The home was built in 1981; and at the time, the applicant could not anticipate all the ways the initial of the home might limit fiiture needs for expansion. e) Granting the variance would not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood. The proposed garage addition is adjacent to other garages across the street on 28t11 Avenue, and fits in with the character of the existing neighborhood. f) The variances would not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion of the public streets, or increase the danger of fire, or endanger the public safety, or substantially diminish or impair property values within the neighborhood. g) The requested variance is the minimum action required to allow the applicant to improve the livability of the home to provide adequate living space for the growing family. The proposed location is the best placement to fit with the angle of the existing home and to minimize the amount of impervious surface on the lot. Resolution 2002-474 (2002117) Page 3 4. A building permit for the addition shall be obtained prior to constriction. 5. This approval shall expire one year after the date of approval, unless the applicant has substantially started constriction of the project, or unless the applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 2 103 0. 06 of the Zoning Ordinance.
