HomeMy WebLinkAboutCity Council Resolution 2002-448CITY OF PLYMOUTH HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 2002-448 ADOPTING AND APPROVING ORDER FOR REMOVAL OF HAZARDOUS EXCAVATION AT PIN# 26-118-22-44-0006 WHEREAS, the Building Official of the City of Plymouth has attempted without success to have the owner of certain property remove three separate foundation wall systems and back fill these basements on the property described as PIN# 26-118-22-44-0006, located in Plymouth, Minnesota; and WHEREAS, the City Council has determined that the open basements on the property constitute a hazardous excavation within the meaning of Minnesota Statutes § 463.25. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Plymouth: 1. Pursuant to Minnesota Statutes § 463.17 et seq., the City hereby adopts and approves the Order to Cease Hazardous Excavation attached hereto as Exhibit "A". 2. The City's legal counsel, CAMPBELL KNUTSON, Professional Association, 317 Eagandale Office Center, 1380 Corporate Center Curve, Eagan, Minnesota 55121, is directed to serve the Order and to proceed with enforcement in accordance with Minnesota Statutes § 463.15 et sec.. 3. The Property Owner shall place "No Trespassing" signs around the Subject Property and shall place fencing around the foundation walls by October 24, 2002. The fencing must meet the approval of Joe Ryan, Plymouth Building Official. 4. The Property Owner has until February 15, 2003 to comply with the terms of the Order For Removal Of Hazardous Excavation. Adopted by the City Council on September 24, 2002.
