HomeMy WebLinkAboutCity Council Resolution 2002-426CITY OF PLYMOUTH RESOLUTION 2002-426 APPROVING SITE PLAN AMENDMENT, CONDITIONAL USE PERMIT AMENDMENT FOR AN EXPANSION, CONDITIONAL USE PERMIT FOR HEIGHT, INTERIM USE PERMIT FOR REDUCED PARKING, AND A FIRE LANE VARIANCE AT PEACE LUTHERAN CHURCH LOCATED AT 3695 COUNTY ROAD 101 (2002099) WHEREAS, SMSQ Architect has requested approval of a site plan, conditional use permit amendment for an expansion, conditional use permit for height, interim use permit for reduced parking, and a fire lane variance for an addition to be constructed at Peace Lutheran Church located at 3695 County Road 101, for property legally described as: That part of the Southwest quarter of the Southeast quarter of Section 18, Township 118 North, Range 22 West, described as follows: commencing at the Southeast corner of said Southwest quarter of the Southeast quarter: thence North along the East line thereof 290.67 feet to the point of beginning of the property being described: thence continuing North 413.33 feet to the point of intersection of said East line with the centerline of Medina Road: thence deflecting left 55 degrees 50 minutes along said centerline a distance of 577.6 feet: thence deflecting left 90 degrees a distance of 342 feet: thence deflecting left to the point of beginning, except the Northeasterly 33 feet of said property: subject to an easement for highway purposes over the East 33 feet of said property. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by SMSQ Architects for a site plan amendment, conditional use permit amendment for an expansion, conditional use permit for height, interim use permit for reduced parking, and a fire lane variance for Peace Lutheran Church located at 3695 County Road 101, subject to the following conditions: Resolution 2002-426 File No. 2002099 Page 2 1. A site plan amendment and conditional use permit amendment is approved to allow construction of an 11,667 square foot addition, in accordance with the plans received by the City on July 31, 2002 and revisions received on August 19, 2002 and September 6, 2002, except as amended by this resolution. 2. A conditional use permit is approved to allow a 54 -foot 3 -inch bell tower with cross, subject to the condition that the steeple Nvill not be illuminated. 3. An interim use permit is approved for reduced parking to allow 87 parking spaces where 100 parking spaces are required by the Ordinance, Nvith the finding that all applicable interim use permit standards are met, subject to the following conditions: a) The church has access and use rights to the 114 parking spaces in the Greenwood Elementary School parking lot. A cross easement agreement with Wayzata School District is required for unobstructed access to the Greenwood Elementary School site. b) The City may terminate the interim use permit if a parking shortage is observed on the site or if there is a documented parking problem. In such case, the applicant would be required to construct additional parking spaces on the site. 4. Prior to issuance of building permits, the applicant shall provide a financial guarantee and Site Improvement Performance Agreement for all site improvements. 5. Prior to issuance of building permits, the applicant shall submit a lighting plan that meets the requirements of Section 21105.06 of the Zoning Ordinance. 6. Anv Nvork within the right of way of County Road 101 requires a permit fi-om Hennepin Countv. 7. A fire lane variance for the north, east, and south sides of the existing building and proposed addition is hereby approved, subject to the following: a) A cross easement agreement shall be provided between the property owners of the church and the Wavzata School District building on the south side of the property. The cross easement agreement shall ensure unobstructed fire access and water supple to the site. b) Fire hvdrants shall be located in approved locations on the site. c) Fire flow calculations for the site hydrants be submitted and approved by the Fire Inspector. d) The fire hydrant water main system must be an approved looped system. Resolution 2002-426 File No. 2002099 Page 3 e) The entire building shall be protected by a cite approved fire sprinlder system and a city approved automatic fire alarm system. 2 8. Comphance with the Ordinance regarding the location of fire hydrants, post indicator-- - - Formatted: Bullets and Numbering valve, fire department connection, fire lanes, and fire lane signage. c. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per Cite Policy. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. fif This approval shall expire one year after the date of approval, unless the property owner-- - - Formatted: Bullets and Numbering or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21030.06 and 21045.09 of the Zoning Ordinance.
