RESOLUTION NO. 2002-409
REQUEST FOR PAYMENT NO. 6
AND FINAL AND PAYMENT NO. 4 AND FINAL
2001 STREET RECONSTRUCTION PROJECT
CITY PROJECT NOS. 1001 & 1005
WHEREAS, the City of Plymouth as owner and Midwest Asphalt Corporation as
contractor, have entered into an agreement for 2001 Street Reconstruction Project, City
Project Nos. 1001 & 1005, said agreement was approved by the City Council on May 8,
2001; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $1,812,702.60. One (1) change
order was approved in the amount of $7,602.65 and the value of the work
to date is $1,741,890.44 and is herewith approved. This project does not
exceed the revised contract amount.
2. That the work performed by the contractor for 2001 Street Reconstruction
Project and certified to the Council by the engineer as acceptable, being the
same, is hereby released from the contract except as to the conditions of
the performance bond, any and all legal rights of the owner, required
guarantees and correction of faulty work after final payment.
3. Request for Payment No. 6 and Final in the amount of $112,285.90 (CP
No. 1001) and Request for Payment No. 4 and Final in the amount of
$6,891.20 (CP No. 1005) to Midwest Asphalt Corporation for 2001 Street
Reconstruction Project is hereby approved and the City Finance Director is
hereby authorized and directed to pay the same forthwith.
