HomeMy WebLinkAboutCity Council Resolution 2002-406CITY OF PLYMOUTH RESOLUTION 2002-406 APPROVING CONDITIONAL USE PERMIT FOR THE BAINEY GROUP FOR PROPERTY LOCATED AT 14700 28TH AVENUE NORTH (2002 100) WHEREAS, The Bainey Group has requested approval of a conditional use permit to increase the percentage of office area from 54 percent to 65 percent in the industrially zoned building located on property legally described as follows: Lot 4, except the West 197.94 feet, Block 1, Circle Star Business Center 2"a Addition, according to the plat thereof on file and of record in the office of the Registrar of Titles in and for Hennepin County, Minnesota, together with easements for driveway and parking purposes over part of the West 197.94 feet of Lot 4, Block 1, Circle Star Business Center 2"a addition as more fully described in Registrar of Titles Document No. 1885241. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by The Bainey Group for a conditional use permit to allow 65 percent office use in the industrially -zoned building located at 14700 28"' Avenue North, subject to the following conditions: 1. The conditional use permit allows up to 4,120 square feet (65 percent) for office use at the 37,542 square -foot building located at 14700 28t1' Avenue North, in accordance with the application and plans received by the City on August 7, 2002, except as amended by this resolution. 2. The appropriate building permits must be obtained by the applicant prior to constriction of the retail space within this building. Resolution 2002-406 (2002100) Page 2 3. Standard Conditions: a. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. b. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has commenced the use, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
