RESOLUTION 2002-401
DENYING A REQUEST BY SAMUEL AND JENNIFER SYRSTAD
TO AMEND SECTION 21145 (HOME OCCUPATIONS)
OF THE PLYMOUTH CITY CODE (2002062)
WHEREAS, an application has been filed by Samuel and Jennifer Syrstad which requests an
amendment to Section 21145 of the Plymouth Zoning Ordinance to allow home occupations to be
conducted within accessory buildings or attached garages; and
WHEREAS, the Planning Commission reviewed the request at a duly called public meeting and
recommended denial of the request;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the request of Samuel and
Jennifer Syrstad to amend the Zoning Ordinance, based upon the following findings:
The proposed amendment is inconsistent with the purpose of Section 21145 of the Zoning
Ordinance (Home Occupations) which is to maintain the character and integrity of residential
areas and to provide a means through the establishment of specific standards and procedures
by which home occupations can be conducted in residential neighborhoods without
jeopardizing the health, safety and general welfare of the surrounding neighborhood.
2. Allowing home occupations to occur in garages or accessory strictures may encourage home
occupations of an industrial nature which have the potential for adverse effects upon
surrounding properties due to noise, deliveries, storage and visual impacts.
