RESOLUTION 2002-398
APPROVING A COMPREHENSIVE PLAN AMENDMENT FOR THE METROPOLITAN
COUNCIL FOR PROPERTY LOCATED AT 5405 VAGABOND LANE NORTH (2002089)
WHEREAS, the Metropolitan Council has requested a comprehensive plan amendment to add
property to the Metropolitan Urban Service Area (MUSA) and reclassify it from LA, R (Living
Area -Rural) to LA -I (Living Area -1), said property located at 5405 Vagabond Lane North, and
legally described as follows:
The South 347 feet of the part of the Southeast Quarter of the Southwest Quarter
lying West of the East 659 feet of the said Southeast Quarter of the Southwest
Quarter of Section 6, Township 118, Range 22, according to the Government
Survey thereof.
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for a
comprehensive plan amendment for the property located at 5405 Vagabond Lane North, based on
the following findings and subject to the following conditions:
Findings
1. Adding the subject property to the MUSA and reguiding it to LA -I is necessary due to the
alignment and impact of the Elm Creek Interceptor, which will require removal of the on-site
mound system for sanitary sewer disposal (private septic system). The natural site
characteristics of the site, including steep slopes, heavily wooded area, and wetlands, together
with the compacting of the soil related to excavation for the sewer, make it infeasible to
replace the mound system on the subject property. Connecting the home to the interceptor
provides the most environmentally sound, cost-efficient manner to provide sewer service to
this existing home.

1. Approval of this comprehensive plan amendment is contingent upon, and subject to, the
required review and response by the Metropolitan Council.
2. Prior to connecting the home at 5405 Vagabond Lane to the interceptor, the applicant must
obtain a sewer connection permit from the City of Plymouth. The sewer connection permit
will require payment of a Sewer Availability Charge, a Sewer Residential Equivalency Charge,
and the sanitary sewer area assessment for one unit.
3. Prior to issuance of the sewer connection permit, the applicant shall provide verification of a
septic abandonment permit from Hennepin County.
4. Only one home on the subject property shall be connected to public sewer until such time as
urban development may be approved for the area.
FURTHER, to incorporate these changes, the City will make modifications to the following
figures in the City's Comprehensive Plan:
1) Figure 4-1 (Page 4-3) entitled "Northwest Plymouth"
2) Figure 4-2 (Page 4-4 entitled "Development Staging Plan"
3) Figure 4-3 (Page 4-22) entitled "2020 Land Use Guide Plan"
4) Figure 10-4 (Page 10-22) entitled "Development Staging Plan"
