HomeMy WebLinkAboutCity Council Resolution 2002-396CITY OF PLYMOUTH RESOLUTION 2002-396 APPROVING FINDINGS OF FACT FOR REZONING OF PROPERTY LOCATED SOUTH OF 8TH AVENUE AND EAST OF HADLEY LAKE (2002055) WHEREAS, Thomas Laitala and Joseph Sorrentino have requested reclassification of the zoning from FRD (Future Restricted Development) to RSF-1 (Single Family Detached 1) for roughly 9.1 acres (6.1 net acres) located at 18315-8"' Avenue North, legally described as follows: All that part of the South half of the Northeast Quarter of Section 31, Township 118 North, Range 22 West, described as follows: Beginning at the Southwest corner of the South half of the Northeast Quarter of said Section 31; thence East along the South line thereof 958.95 feet; thence North 647.53 feet; thence West 973.67 feet to the West line of said South half, thence South 654.6 feet to the point of beginning; except that part thereof lying in the plat ofFAZENDIN-KROGNESS ADDITION. Also Beginning at a point on the East line of the Northeast Quarter of the Southwest Quarter of Section 31, Township 118 North, Range 22 West of the 5"' Principal Meridian distant 9.8 chains South from the Northeast corner thereof, thence North along the East line of the West half of said Section 1301.4 feet; thence West parallel with the North line of the Southeast Quarter of the Northwest Quarter a distance of 240 feet; thence South parallel with said East line of the West half of said Section a distance of 997.32 feet; thence Southwesterly to the point of beginning. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected property from FRD (Future Restricted Development) to RSF-1 (Single Family Detached 1). Resolution 2002-396 (2002055) Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from FRD (Future Restricted Development) to RSF-1 (Single Family Detached 1) for the roughly 9.1 acres (6.1 net acres) located at 18315-8"' Avenue North, based on the following findings: 1. The proposed RSF-1 zoning classification is consistent with the LA -1 guiding of the Comprehensive Plan. 2. Except for the lot width of Lot 5 (for which a variance was requested), all lots would exceed the lot standards specified by the RSF-1 zoning district. 3. The proposed lower density for this site would result in a development that balances preservation of the environment with reasonable and responsible use of land, by allowing preservation of more trees and landforms. A reduction in the number of homes would also result in less impervious surface coverage, thereby reducing runoff to the lake. Furthermore, the proposal would result in a development that would be compatible with the existing character of the surrounding RSF-1 properties. 4. The proposed RSF-1 zoning classification would help to preserve and maintain the established larger lot development pattern of the adjacent RSF-1 neighborhood. 5. There would be adequate infrastructure available to support RSF-1 zoning and the development proposed for this site. ADOPTED by the City Council on August 27, 2002.
