HomeMy WebLinkAboutCity Council Resolution 2002-391CITY OF PLYMOUTH DRAFT RESOLUTION NO. 2002-391 AUTHORIZING THE EXECUTION OF A COOPERATION AGREEMENT BETWEEN THE PLYMOUTH HOUSING AND REDEVELOPMENT AUTHORITY (HRA) AND THE MINNEAPOLIS PUBLIC HOUSING AUTHORITY (MPHA) TO INCLUDE 13 METROPOLITAN HOUSING OPORTUNITY PROGRAM UNITS FOR THE STONE CREEK VILLAGE APARTMENT PROJECT WHEREAS, the Minneapolis Public Housing Authority in and for the City of Minneapolis (the "MPHA") holds an Annual Contributions Contract ("MPHA ACC") from the United States Department of Housing and Urban Development ("HUD") for funding the capital and operating costs of low rent public housing units and projects throughout the Minneapolis -St. Paul Twin Cities metropolitan area pursuant to a certain decree entered in United States District Court (the "Consent Decree"); and WHEREAS, the MPHA has established the Metropolitan Housing Opportunity Program ("MHOP") pursuant to which it will cooperate with suburban counties and municipalities in the constriction and operation of qualified housing units (the "MHOP Units"); and WHEREAS, Dominium Development, Inc., on behalf of Plymouth Leased Housing Associates, Limited Partnership, (the "Owner"), has applied to the MPHA and to the Housing and Redevelopment Authority in and for the City of Plymouth ("HRA"), to locate thirteen (13) MHOP Units in a 130 -unit multifamily housing development to be known as Stone Creek Village (the "Development') to be located within the City of Plymouth, Minnesota (the "City"); and WHEREAS, as part of the fiinding of the MHOP Units, HUD requires that the City agree, pursuant to the authority granted the City by Minnesota Statutes, 469.040, to exempt the MHOP Units from property taxation in consideration of agreement by the MPHA and the HRA to subject said units to payments in lieu of taxes; and WHEREAS, the vehicle for approving such tax treatment is a Cooperation Agreement between and among the MPHA, the HRA and the City NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the Cooperation Agreement with the Plymouth Housing and Redevelopment Authority and Minneapolis Public Housing Authority is hereby approved in substantially the attached form; that the Mayor and City Manager of the City are authorized to execute said Cooperation Agreement on behalf of the City; that the Mayor and City Manager are authorized to make such changes in said Cooperation Agreement as are not inconsistent with the spirit and purpose thereof, and that this Resolution shall take effect immediately.
