RESOLUTION 2002-389
APPROVING A SIDE YARD SETBACK VARIANCE FOR SKI) ARCHITECTS FOR
PROPERTY LOCATED AT 2960 PILGRIM LANE NORTH (2002086)
WHEREAS, an application has been filed by SKI) Architects which requests approval of a
variance for a 10 -foot side yard setback for an addition for property legally described as follows:
Lot 3, Block 2, Ridgecrest -1 Addition, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the variance request for
a 10 -foot side yard setback for an addition for property located at 2960 Pligrim Lane North,
subject to the following findings and conditions:
1. This variance request to permit a 10 -foot side yard setback is hereby approved in accordance
with the application and plans received by the City on July 3, 2002, and additional information
on July 30, 2002 except as amended by this resolution.
2. The proposed addition shall be properly graded, and not have any negative affect on drainage
on the adjacent properties.
3. The addition shall be finished to match the existing home.
4. This resolution is approved with the finding that the applicable variance standards have been
met. Specifically:

a) The lot size is 17,433 square feet where 18,500 square feet is the minimum lot size
required in the RSF-1 Zoning District. The parcel also contains 88 feet of street frontage,
where 110 feet is the minimum street frontage required in the RSF-1 Zoning District.
This limits the expansion toward the side yard, which is the most logical area for
expansion from an architectural standpoint. The home was designed for expansion on
both the home and garage sides based on the original 10 -foot setback.
b) The conditions of the parcel are unique and are not applicable, generally, to other property
within the same zoning classification due to the change in minimum setback requirements
from 10 feet to 15 feet.
c) The request is not based exclusively upon a desire to increase value or income potential of
the property. The proposed addition would allow the current residents to increase the
livability of their home and provide additional space to accommodate a family of eight.
d) Granting the variance would not be detrimental to the public welfare or injurious to other
land or improvements in the neighborhood. The proposed addition would be built to
match the exterior of the existing home.
e) The hardship is caused by the Zoning Ordinance and is not self-created. The home was
built in 1985; prior to the Zoning Ordinance update in 1996 which changed the minimum
setbacks from 10 feet to 15 feet.
f) The variances would not impair an adequate supply of light and air to adjacent property,
or substantially increase the congestion of the public streets, or increase the danger of fire,
or endanger the public safety, or substantially diminish or impair property values within
the neighborhood.
g) The requested variance is the minimum action required to allow the current residents to
improve the livability of their home to provide adequate living space for their family of
eight. The proposed location is the best placement to fit with the existing home
architecturally.
5. A building permit for the addition shall be obtained prior to constriction.
6. This approval shall expire one year after the date of approval, unless the applicant has
substantially started constriction of the project, or unless the applicant has received prior
approval from the City to extend the expiration date for up to one additional year, as
regulated under Section 2 103 0. 06 of the Zoning Ordinance.
