HomeMy WebLinkAboutCity Council Resolution 2002-377CITY OF PLYMOUTH RESOLUTION NO. 2002-377 AUTHORIZING THE VACATION OF THE UTILITY AND DRAINAGE EASEMENT, DRIVEWAY EASEMENT, AND WATER ACCESS EASEMENT DOCUMENT NO. 6938055 WHEREAS, a petition was received to vacate the drainage and utility easement, driveway easement, and water access easement recorded under Document No. 6938055 within Winnen Addition; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for August 13, 2002 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of August 13, 2002; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on August 13, 2002 to inform any and all interested parties relevant to the vacation of the utility and drainage easement, driveway easement, and water access easement within Winnen Addition; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; Resolution No. 2002-377 Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following utility and drainage easement, driveway easement, and water access easement within the Winnen Addition recorded under Document No. 6938055 be vacated: That part of Lot 1, Block 1, WINNEN ADDITION, except the east 115.00 feet thereof, which is described as follows: Commencing at the northwest corner of said east 115.00 feet; thence on an assumed bearing of West, along the north line of said Lot 1, a distance of 33.01 feet, to the point of beginning; thence South 47 degrees 38 minutes 04 seconds West 259.73 feet to a point on the south line of said Lot 1 distant 225.60 feet west of the southwest corner of said east 115.00 feet; thence South 89 degrees 35 minutes 20 seconds West, along said south line 94.40 feet to the southwest corner of said Lot 1; thence North 0 degrees 13 minutes 35 seconds West, along the west line of said Lot 1, a distance of 175.50 feet, to the northwest corner of said Lot 1; thence on a bearing of East 286.99 feet to the point of beginning. Whereas, the easements considered for vacation are legally described as follows: An easement for drainage and utility purposes over, under and across the northerly 6.00 feet and the southeasterly 10.00 feet of the above-described land; and An easement for driveway purposes over and across that part of the north 45.00 feet of said Lot 1 which lies westerly and northwesterly of a line drawn 25.00 feet southeasterly of and parallel with the southeasterly line of the above-described land; and An easement for water access over and across the southerly 10.00 feet of the above- described land.
