RESOLUTION NO. 2002-376
AUTHORIZING THE VACATION OF
A DRIVEWAY EASEMENT
DOCUMENT NO. 6938054
WHEREAS, a petition was received to vacate the drainage easement within Winnen Addition; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for August 13, 2002 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of August 13, 2002; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on August 13, 2002 to inform any and all interested
parties relevant to the vacation of the driveway easement within Winnen Addition; and
WHEREAS, it was determined by the City Council that said easement was not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following driveway easement, recorded under Document No.
6938054 be vacated:
That part of Lot 1, Block 1, WINNEN ADDITION, except the east 115.00 feet thereof,
which is described as follows:

Beginning at the northwest corner of said east 115.00 feet; thence on an assumed
bearing of West, along the north line of said Lot 1, a distance of 33.01 feet;
thence South 47 degrees 38 minutes 04 seconds West 259.73 feet to a point on
the south line of said Lot 1, distant 225.60 feet west of the southwest corner of
said east 115.00 feet; thence North 89 degrees 35 minutes 20 seconds East,
along said south line 225.60 feet to the southwest corner of said east 115.00 feet;
thence North 0 degrees 13 minutes 35 seconds West along the west line of said
east 115.00 feet, 173.40 feet to the point of beginning.
WHEREAS, the easement considered for vacation is legally described as follows:
An easement for driveway purposes over and across that part of the north 45.00 feet of
said Lot I which lies westerly and northwesterly of a line drawn 25.00 feet
southeasterly of and parallel with the northwesterly line of the above described land.
Adopted by the City Council on August 13, 2002.
