HomeMy WebLinkAboutCity Council Resolution 2002-355CITY OF PLYMOUTH RESOLUTION 2002-355 APPROVING SITE PLAN FOR PARKING EXPANSION AND VARIANCE FOR PARKING SETBACK FOR LIFETIME FITNESS/ICE CENTER LOCATED AT 3600 AND 3650 PLYMOUTH BOULEVARD (2002088) WHEREAS, the City of Plymouth has requested approval of a site plan amendment and variance for property legally described as: Lots 1, 2, 3, and 4, Block 1, Plymouth Center -1 Addition, Hennepin County, Minnesota; and WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by the City of Plymouth for a site plan amendment and variance for parking expansion at the Lifetime Fitness/Ice Center, subject to the following conditions: 1. A site plan amendment and variance is approved to allow parking expansion for the Lifetime Fitness/Ice Center complex located at 3600 and 3650 Plymouth Boulevard, in accordance with the plans received by the City on July 24, 2002, except as amended by this resolution. 2. A variance is approved to allow a 6 -foot setback from the lot line to the parking located in the front, where 20 feet is required by the Ordinance, as shown on the plans dated July 24, 2002, based on the finding that: (a) The existing conditions of the property result in a particular hardship to the owner, if the strict letter of the regulations were to be carried out. There is limited open space on the site that is not wetland and there is no other location for additional parking. Resolution 2002-355 File No. 2002088 Page 2 (b) The conditions for the variance are unique. Due to the curvature of the existing parking in front of the property and the limited open space, there are no other suitable locations for parking. (c) The purpose of the variance is not based exclusively upon a desire to increase the value or income potential of the parcel of land. The variance request is necessary to provide additional parking on site. (d) The circumstances surrounding the variance request were not self-created. (e) The proposed improvements would not be detrimental to the public welfare or injurious to other land in the neighborhood. The proposed setback would still provide some separation between the parking and lot line. (f) The proposed improvements would not impair an adequate supply of light and air to adjacent property, endanger public safety, increase congestion of the public streets, increase the danger of fire or substantially diminish property values in the neighborhood. (g) The requested variance is the minimum action required to eliminate the hardship. The encroachment into the parking setback would vary from 2 feet to 14 feet. 3. The lighting plan shall be revised to meet the minimum and maximum lighting intensity levels as required by Section 21105.06. 4. The point of transfer location and tank relief valves for the existing propane tanks must be a minimum of 10 feet from parking. 5. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Compliance with the Ordinance regarding the location of fire hydrants, post indicator valve, fire department connection, fire lanes, and fire lane signage. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21030.06 and 21045.09 of the Zoning Ordinance.
