RESOLUTION NO. 2002-295
COMMENTS ON THE PROPOSED
MINNEHAHA CREEK WATERSHED DISTRICT RULES
WHEREAS, the City of Plymouth has reviewed the proposed Minnehaha Creek Watershed District rile
changes dated June 20, 2002; and
WHEREAS, the City of Plymouth concurs with establishing buffer and wetland riles to prevent
degradation of our local natural resources; and
WHEREAS, the City of Plymouth is concerned with potential conflicts between the District's proposed
new riles with the existing City ordinances and the practicality of implementing some of the proposed
riles;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That, the City Council recommends the following changes to the
Minnehaha Creek Watershed District's proposed new riles:
1. The Guidance Document (Dated June 20, 2002, section E2) indicates that "The District does not
prevent any municipality, under its own authority, from adopting a wetland buffer ordinance where
widths are based on function and value." However, there is no clear indication in the proposed riles
how this will be done. It appears likely that the buffer requirements will be changed again in a
relatively short period of time. It seems to make more sense to avoid the inconsistency of multiple
changes in requirements and continue to use the existing buffer requirements until a system based on
wetland quality is instituted. The City believes the proposed buffer rile should not be instituted at this
time.
2. The City is concerned that the buffer requirement for lakes and wetlands has a significant impact on
private property. This requirement requires a clear understanding by the public of the issues and
impacts. An open public process providing information and opportunity to comment to individual
property owners should be implemented prior to institution of a buffer requirement for lakes and
streams.
3. The City has been implementing a stormwater management plan based on using existing basins to
limit flooding since the early 1970's. It is unclear what impact the new requirements in Rule N —
Stormwater Management regarding impact on downstream waterbodies might have on the City's
system. Additional flexibility should be added to this rile to allow for management of the City's
stormwater system.
