HomeMy WebLinkAboutCity Council Resolution 2002-291CITY OF PLYMOUTH RESOLUTION 2002-291 APPROVING FINDINGS OF FACT FOR ZONING ORDINANCE TEXT AMENDMENT TO ALLOW ENCROACHMENTS IN DRAINAGE AND UTILITY EASEMENTS. (2002056) WHEREAS, the Planning Commission has reviewed the text amendment at a duly called Public Hearing; and WHEREAS, the City Council has adopted a Zoning Ordinance text amendment to allow encroachments in drainage and utility easements. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve a Zoning Ordinance text amendment to allow encroachments into drainage and utility easements, based upon the following findings: 1. Allowing encroachments into drainage and utility easements when consistent with the intent of the easement would be consistent with the surface water chapter of the City's Comprehensive Plan. 2. Allowing encroachments for steps, decks, terraces, play facilities, detached gazebos, etc. in drainage and utility easements, when the intent of the easement is not compromised, is consistent with allowing driveways to encroach into easements, as is allowed by Section 21135.08, Subd. 5 (b). 3. Allowing the encroachment only if approved by the City Engineer allows property owners flexibility while also protecting the intent of the easement.
