HomeMy WebLinkAboutCity Council Resolution 2002-289CITY OF PLYMOUTH RESOLUTION 2002-289 APPROVING A FRONT YARD SETBACK VARIANCE FOR BILL WEIMER FOR PROPERTY LOCATED AT 3675 DALLAS LANE NORTH (2002029) WHEREAS, an application has been filed by Bill Weimer which requests approval of a variance to allow a garage addition that would encroach 5 feet where 25 feet is specified for property legally described as follows: Lot 7, Block 1, Criterion M.P.U.D., Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Bill Weimer for a variance to allow a garage addition that would encroach 5 feet into the required 25 - foot front yard setback for property located at 3675 Dallas Lane North, based upon the following findings findings and conditions: 1. This variance request to permit a 20 -foot front yard setback is hereby approved in accordance with the application and plans received by the City on March 21, 2002, except as amended by this resolution. 2. The garage addition shall be finished to match the existing home and garage. This resolution is approved with the finding that the applicable variance standards have been met. Specifically: a. The applicant stated that the purpose of the addition is to utilize the existing garage space for a shop and storage area. The applicant would still have a 20 -foot front yard setback and an average of 19 feet of right of way to the street. Staff finds that 39 feet from a residential home to a local street is a typical situation in Plymouth. Resolution 2002-289 (2002029) Page 2 b. A common boulevard found within the City is 8.5 feet along each side of a local street. In this case, however, the average boulevard is roughly 19 -feet wide. Combining this wider than typical boulevard with the proposed 20 -foot setback would maintain a roughly 39 - foot separation between the actual roadway to the proposed garage addition. c. The request is not based upon a desire to increase value or income potential of the property. The proposal would allow the addition of a two -stall garage and a remodel of the existing garage to a shop and storage area for the convenience and improved livability of the property owners. d. The hardship is caused due to the shape of the applicant's lot and the platting of the Dallas Lane cul-de-sac. Unlike many other cul-de-sacs within the City, the right-of-way for the Dallas Lane cul-de-sac does not follow the shape of the street (see attached location map). If the applicant's lot were platted similar to other cul-de-sacs within the City and if the right-of-way were smaller than eight feet, the applicant would not require a variance. e. The granting of the variance would not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood. The applicant would design the garage addition to be consistent with the character of the home. f. The variance would not impair an adequate supply of light and air to adjacent property, nor would it substantially increase the congestion of the public streets, or increase the danger of fire, or endanger the public safety, or substantially diminish or impair property values within the neighborhood. g. The requested variance is the minimum action required to eliminate the hardship. ADOPTED by the City Council this 25"' day of June, 2002. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
