HomeMy WebLinkAboutCity Council Resolution 2002-276CITY OF PLYMOUTH RESOLUTION NO. 2002-276 REIMBURSING DEVELOPER FOR CONSTRUCTION OF SANITARY SEWER AND TRUNK WATERMAIN PEONY PROMENADE (20004) WHEREAS, on August 22, 2000 the City Council adopted Resolution 2000-421 approving the Site Plan and Conditional Use Permit for Peony Promenade; and WHEREAS, as part of that approval a public sanitary sewer and public watermain was required to be extended from Peony Lane westerly across the property; and WHEREAS, other properties will incur benefit from this sanitary sewer and watermain extension and the City should incur a portion of the cost for the part of the utilities within the Peony Lane right-of-way; and WHEREAS, extraordinary costs were incurred by the developer, Reliance Development Company, Inc., in the constriction of the sanitary sewer and watermain; and WHEREAS, Reliance Development Company's engineer has certified that the work to date complies with the approved plans and specifications; and NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the developer, Reliance Development Company, Inc., is to be reimbursed in the amount of $70,837.76 for the constriction of the public improvements including sanitary sewer and trunk watermain in accordance with the Site Plan and Conditional Use Permit for Peony Promenade and City Policy. BE IT FURTHER RESOLVED that the funds be allocated from the City's Trunk Utility fund. FURTHER BE IT RESOLVED that the constriction of the public sanitary sewer and trunk watermain is accepted for continuous maintenance as of June 11, 2002 subject to a two-year guarantee by the developer per Maintenance Bond No. 37SB 103770018 issued by Travelers Casualty & Surety Company of America.
