RESOLUTION 2002-254
APPROVING CONDITIONAL USE PERMIT AMENDMENT AND SITE PLAN
AMENDMENT FOR ST. PHILIP THE DEACON LUTHERAN CHURCH FOR PROPERTY
LOCATED SOUTH OF COUNTY ROAD 6 AND EAST OF COUNTY ROAD 101 (2001006)
WHEREAS, St. Philip the Deacon Lutheran Church has requested approval of a conditional use
permit amendment and site plan amendment to allow expansion of the church parking lot on the
property legally described as follows:
All that part of the East 600 feet of the Southwest Quarter of the Southwest Quarter of Section
29, Township 118, Range 22 lying South of the Southerly right of way line of County Road No.
6, and North of the South 577.4 feet thereof, according to the United State Government Survey
thereof and situated in Hennepin County, Minnesota.

Hennepin County, Minnesota.

Lot 10, Block 1, PLYMOUTH SQUARE, according to the recorded plat thereof and situated in
Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by St.
Philip the Deacon Lutheran Church for a conditional use permit amendment and site plan
amendment, subject to the following findings and conditions:

1. A site plan amendment and conditional use permit amendment are approved for a parking lot
expansion in accordance with the May 28, 2002 plan prepared by City staff, except as
amended by this resolution. The church may constrict all or part of the additions and
modifications to the parking lot as shown on the plan.
2. The approved plan accomplishes the goals of the church by adding up to 89 additional parking
spaces to the site, as requested in the application. At the same time, the plan addresses the
City's concerns that the proposed parking lot expansion would have a negative impact on the
adjoining neighborhood due to the loss of privacy and increase in noise as a result of
protrusion of the parking lot into the neighborhood. It also addresses the concern that the
plan would damage the continuity of the streetscape and character of the neighborhood, and
lower the quality of life of the property owners in the neighborhood due to the loss of an
adequate transition between the uses.
3. The existing strictures (single family dwellings) located on Lots 9 and 10, Block 1, Plymouth
Square shall be retained. The applicant may utilize these strictures as dwellings, for any
church -related activity, or for any use allowed by the Zoning Ordinance subject to the
requirements of the Building and Fire Codes.
4. There shall be no access from the parking lot to 14"' Avenue.
5. This approval is not contingent upon City Council approval of the applicant's related request
for a lot consolidation to combine the three subject parcels into one lot. If the applicant
chooses to consolidate the lots, this conditional use permit amendment approves more than
one principal building per lot as allowed by Section 21105.03 Subd. 4 of the Zoning
Ordinance.
6. Approval of any wetland fill required for this plan is contingent upon City Council approval of
a certificate of exemption for the proposed wetland fill.
7. Prior to commencement of the project, the applicant shall enter into a Site Improvement
Performance Agreement and provide a financial guarantee for any additional landscaping
required by the plan. A financial guarantee will not be required for constriction of the
parking lot.
8. Standard Conditions:
a. Compliance with the City Engineer's Memorandums.
b. This approval shall expire one year after the date of approval, unless the property owner
or applicant has substantially started constriction of the project, or unless the landowner
or applicant has received prior approval from the City to extend the expiration date for up
to one additional year, as regulated under Sections 21015.07 and 21045.09 of the Zoning
Ordinance.
