HomeMy WebLinkAboutCity Council Resolution 2002-234CITY OF PLYMOUTH RESOLUTION 2002-234 APPROVING A FINAL PLAT FOR RYLAND HOMES, INC. FOR PHASES I AND II OF "THE FIELDS OF NANTERRE" LOCATED NORTH OF SCHMIDT LAKE ROAD AND WEST OF VICKSBURG LANE NORTH (2001148F) WHEREAS, Ryland Homes has requested approval of a final plat for "The Fields of Nanterre", a plat of 112 townhouse lots, four common open -space lots and one outlot on roughly 45.6 acres located north of Schmidt Lake Road and west of Vicksburg Lane North; and WHEREAS, the property is legally described as follows: That part of Outlot K embraced within the Southeast Quarter of the Northeast quarter of Section 8, Township 118, Range 22, Nanterre, Hennepin County, Minnesota, and, Outlot K, Nanterre, according to the plat thereof, less and except that part of Outlot K embraced within the southeast quarter of the northeast quarter of Section 8, Township 118, Range 22, Hennepin County, Minnesota. And, The North 654.42 feet of the southeast quarter of the northeast quarter of Section 8 Township 118, Range 22, as measured along the East and West lines thereof, Hennepin County, Minnesota. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Ryland Homes for a final plat for Phases I and II, The Fields of Nanterre; and, FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, Resolution 2002-234 (2001148F) Page 2 FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. This final plat approves 112 townhouse lots, four common open -space lots and one outlot, in accordance with the plans received by the City on April 9, 2002, April 11, 2002 and April 24, 2002, except as amended by this Resolution. 2. Prior to recording the final plat, the developer shall pay the park dedication fees for Phases I and II with credit for land dedicated for Trail Outlots A (partial), B, and C pursuant to the Dedication Policy in effect at the time of recording the final plat, for the total number of units shown on the plans. 3. Prior to recording the final plat, the applicant shall submit the required easements as specified in the Engineer's Memo and as approved by the City Engineer. 4. Prior to recording the final plat, an encroachment agreement is required between the developer and the City for the mail box strictures proposed within the right-of-way. 5. Homeowner Association documents, covenants and restrictions shall be filed with the Final Plat. Proof of recording shall be furnished to the City. 6. Prior to the issuance of building permits, the applicant shall apply for a permit and install the disclaimer sign to be posted on City property disclosing the future development of the site for a ground storage facility for drinking water and the potential of a future fire station. In addition to the design submitted, the sign shall be framed and installed on a minimum of two posts. 7. Prior to the issuance of building permits, the applicant shall submit a revised landscaping plan, in compliance with the Zoning Ordinance requirements, showing correspondence between the planting schedule and the plan and moving all proposed landscaping from the easements between the city property and the adjacent units. 8. All signage shall comply with the Sign Ordinance. No variances are granted or implied. 9. Development standards shall be as required by the RMF -2 district. No variances are granted or implied. 10. All sidewalks internal to the development shall be privately maintained, including those adjacent to Archer Lane North, 50t11 Avenue, Yuma Lane North, and Weston Lane North. 11. All buildings in the development shall be protected by a City approved NFPA 1313 or 13R automatic fire sprinkler system approved by the City. Resolution 2002-234 (2001148F) Page 3 12. A fence, not exceeding six feet in height, shall be provided for privacy and screening in the front yard along Schmidt Lake Road as shown on the landscape plan. The fence shall be owned and maintained by the homeowners association. 13. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Prior to the issuance of any building permits, a pond maintenance agreement is required between the developer and the City for the water quality pond. The agreement shall be recorded with the plat. c. Prior to the issuance of any building permits, the applicant shall submit the required Financial Guarantee and Site Performance agreement for completion of site improvements within twelve months of the date of this Resolution. d. Prior to the issuance of building permits, wetland buffer monuments shall be placed in accordance with Section 21670.07 of the Zoning Ordinance. e. No building permits shall be issued until a contract has been awarded for sewer and water and issued. f. No building permits, except for one model stricture, shall be issued until the final plat is filed and recorded with Hennepin County. g. Prior to the issuance of any utility or building permits, fire flow calculations in conformance with City ordinances and policies, shall be submitted. h. Compliance with the City Code regarding the location of fire hydrants and fire land signage. i. Street names shall comply with the City Street Naming System. j. Removal of all hazardous trees from the property at the owner's expense. k. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility.
