RESOLUTION 2002-199
APPROVING LOT DIVISION AND VARIANCE FOR CARLSON REAL ESTATE
FOR THE ROUGHLY 42 -ACRE SITE LOCATED SOUTHEAST OF I-494 AND
COUNTY ROAD 6 TO CREATE SEPARATE PARCELS FOR THE CARLSON
MARKETING GROUP (CMG) BUILDING (ADDRESSED 1405 XENl[_ M LANE)
AND FOR THE CARLSON DAYCARE CENTER BUILDING (ADDRESSED 13905
COUNTY ROAD 6) (2002024)
WHEREAS, an application has been filed by Carlson Real Estate which requests approval
of a lot division and variance to create separate parcels for the CMG building and the
Carlson Daycare Center building; and
WHEREAS, the existing lot arrangement of the subject property is legally described on
Attachment One, attached hereto and hereby made a part hereof, and
WHEREAS, the proposed lot arrangement for the subject properties is legally described
on Attachment Two, attached hereto and hereby made a part hereof, and
WHEREAS, the Planning Commission has reviewed said request at a duly called public
meeting and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request for lot division and variance by Carlson Real Estate, subject to the following
findings and conditions:
1. The lot division and variance is granted in accordance with the plans received by the
City on March 20, 2002, except as may be amended by this resolution.

2. A variance to allow creation of Parcel A without direct access onto a public street is
granted based upon the following findings:
a) A hardship exists because there is no opportunity to add an additional cut curb for
the daycare center site (Parcel A). The variance would be reasonable and would
serve to make financing, risk allocation, and maintenance of the two buildings
easier in the future.
b) The circumstances related to this request are not generally applicable to other
properties in the I-2 district. This roughly 41 -acre site is bounded by three major
roadways with access restrictions, including I-494 to the west, County Road 6 to
the north, and Xenium Lane (County Road 61) to the east. The Chicago
Northwestern Railroad abuts the south boundary of the site.
c) The request is not based upon a desire to increase value or income potential.
d) The conditions relating to the hardship were not created by the landowners.
e) The granting of the variances would not be detrimental to the public welfare or
injurious to the neighborhood. The proposal would not involve any physical
changes to the site.
f) The granting of the variances would not impair an adequate supply of light and air
to adjacent property, increase the danger of fire, endanger the public safety,
substantially diminish property values within the neighborhood, or create traffic
congestion in public streets.
g) The requested variance is the minimum action required to alleviate the hardship.
3. Prior to filing the lot division with Hennepin County, submission of the required utility
and drainage easement documents, as approved by the City Engineer.
4. Prior to filing the lot division with Hennepin County, submission of the required cross -
access and cross -utility documents, as approved by the City Engineer.
5. The previously approved site plans and conditional use permits for this site, together
with all conditions related thereto, shall remain in fiill force.

6. Standard Conditions:
a) Compliance with the City Engineer's Memorandum.
b) This approval shall expire one year after the date of approval, unless the landowner
or applicant has started the project, or unless the landowner or applicant has
received prior approval from the City to extend the expiration date for up to one
additional year, as regulated under Section 2 103 0. 06 of the Zoning Ordinance.

according to the recorded plat thereof, and situate in Hennepin County, Minnesota, which
lies westerly and southerly of the following described line:
Commencing at the most westerly corner of said Lot 1; thence on an assumed bearing
North 87 degrees 45 minutes 47 seconds East along the southerly line of said Lot 1 a
distance of 90.32 feet; thence North 55 degrees 43 minutes 46 seconds East, along the
southerly line of said Lot 1 a distance of 509.18 feet to the beginning of the line to be
described; thence North 6 degrees 23 minutes 58 seconds West a distance of 177.20 feet;
