RESOLUTION NO. 2002-177
AUTHORIZING CONDEMNATION PROCEEDINGS
HENNEPIN COUNTY ROAD 101 IMPROVEMENT
HENNEPIN COUNTY PROJECT 8911
CITY PROJECT NO. 9005
WHEREAS, the County of Hennepin and City of Plymouth have undertaken the County Road 101
Improvement Project, from Co. Rd. 24 to State Highway 55, County Project No. 8911 and City
Project No. 9005; and
WHEREAS, in order to constrict the improvements, certain permanent and temporary easements are
required; and
WHEREAS, per Agreement No. PW 47-17-00 between Hennepin County and the City of Plymouth
dated February 27, 2000, requires the City to obtain the necessary easements and permanent rights-
of-way on parcels No. 43, 44, 45, 45A, 46, 47 and 49; and
WHEREAS, the City has obtained the necessary easements of right-of-way from parcels No. 43, 46
and 49; and
WHEREAS, the City Council finds it necessary, proper, and expedient in the interests of the public
health, convenience and general welfare of the citizens of the City of Plymouth for the City to acquire
said easements identified as parcels No. 44, 45, 45A and 47; and
WHEREAS, the City Council finds that the constriction schedule for said public project makes it
necessary to acquire title to and possession of the easement interests prior to the filing of the final
report of the condemnation commissioners to be appointed by the district court; and
WHEREAS, the use of Minn. Stat. Sec. 117.042 (1988), so-called "Quick -Take" statute, will enable
the City to timely acquire the required lands;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the City Attorney is hereby authorized to commence
condemnation proceedings utilizing said "Quick -Take" statute for City Project No. 9005 for the
following described easements within the following described parcels:
