RESOLUTION NO. 2002-170
AMENDING DEVELOPMENT CONTRACT
HARVEST HILLS ADDITION (2001023)
WHEREAS, the City entered into a development contract (42001023) with Town and Country
Homes on September 10, 2001 for the plat, Harvest Hills; and
WHEREAS, the City is responsible for the incremental cost of public improvements above that
which is the responsibility of the developer under the City's assessment policy; and
WHEREAS, the development contract was based on constriction costs that have increased
significantly due in part to the time of year the developer proceeded with the constriction work;
and
WHEREAS, it is necessary to amend the Development Contract for Harvest Hills Addition
because of the cost increase for the public street and utilities for both the developer and the City.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: that it should and hereby does approve amending the
Development Contract for Harvest Hills Addition as follows and authorizing the Mayor and City
Manager to sign the amended contracts:
Page 1, revise date.
Page 8, item 2-b, cost to be reimbursed to the developer. Street cost increased from $74,082 to
$83,029. Trail cost increase from $20,160 to $24,717. Total cost including engineering
increased from $94,242 to $107,746.
Page 9, item 3.3, cost to be reimbursed to the developer. Holly Lane watermain increased from
$56,649 to $66,986. Schmidt Lake Road watermain increased from $27,681 to 40,847. Total
cost including engineering increased from $84,330 to 107,833.
Page 9, item 4.3, administrative fee increase from $28,644 to $37,824.
Page 10, item 6.1. Guarantee of performance increase for a letter of credit from $1,432,217 to
$1,891,182 and for a bond from $2,148,325 to $2,836,772.
Page 12, estimated costs.
