HomeMy WebLinkAboutCity Council Resolution 2002-157CITY OF PLYMOUTH RESOLUTION 2002-157 APPROVING A SITE PLAN, CONDITIONAL USE PERMIT, INTERIM USE PERMIT, AND VARIANCES FOR ZB COMPANIES INC., FOR PROPERTY LOCATED NORTH OF 10TH AVENUE AND EAST OF TRENTON CIRCLE (2001133) WHEREAS, ZB Companies, Inc. has requested approval of a site plan, conditional use permit, interim use permit, and variances to allow constriction of an 8,043 square foot freestanding office building on property legally described as Outlot B, Trenton Ponds; and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by ZB Companies, Inc., for a site plan, conditional use permit, interim use permit, and variances for property located north of 10"' Avenue and east of Trenton Circle, subject to the following conditions: 1. A site plan is approved for an 8,043 square foot office building, in accordance with the plans received by the City on January 29, 2002 and March 4, 2002, except as amended by this resolution. 2. This approval is contingent upon City Council approval of a Certificate of Exemption for the proposed wetland fill. 3. This approval is contingent upon City Council approval of the final plat. A conditional use permit is approved to allow a freestanding office building as a principal use in the I-2 (General Industrial) zoning district, with the finding that all the applicable conditional use permits standards are met. 5. An interim use permit for reduced parking is approved to allow installation of 26 parking spaces rather than 29 parking spaces, with the finding that all applicable interim use permit standards are met. 6. A setback variance is approved to allow the building to be set back 6 feet from the east lot line, where 15 feet is specified, with the finding that all applicable variance standards are met. 7. A setback variance is approved to allow the drive aisle to be set back 6 feet from the east lot line, where 15 feet is specified, with the finding that all applicable variance standards are met. 8. A variance is approved to the requirement for a fire lane around the building, subject to the following: A. The entire building shall be protected by a City -approved automatic fire sprinkler system. B. Fire hydrants shall be placed in locations as approved by the Fire Inspector. C. Fire flow calculations shall be submitted for City review and approval prior to the issuance of building permits. D. Fire Department turn-arounds shall be located as approved by the Fire Inspector. E. City -approved Fire Department standpipes may be required on the interior of the building. 9. Prior to issuance of the building permit, the applicant shall pay the park dedication fee - in -lieu of land dedication. 10. Prior to issuance of the building permit, the applicant shall enter into a Site Improvement Performance Agreement and shall submit the required Financial Guarantee for completion of site improvements. 11. Prior to issuance of the building permit, the applicant shall submit a revised lighting plan that complies with the ordinance. 12. Prior to issuance of the building permit, the applicant shall submit a revised plan decreasing the height of the chain link fence from six feet to four feet. 13. Prior to issuance of the building permit, the applicant shall submit a revised landscape plan that replaces the pin oak trees with swamp white oak trees. Resolution 2002-157 (2001133) Page 3 14. Prior to issuance of the building permit, the applicant shall submit a revised grading, drainage, and erosion control plan for review and approval by staff that incorporates extraordinary management practices to protect the wetland during the constriction of the building and retaining walls related to the parking lot and water -quality pond. 15. Prior to issuance of the building permit, the applicant shall submit constriction plans showing that the constriction method will protect and minimize the impact on the wetland. 16. Prior to issuance of building permits, the applicant shall enter into a pond maintenance agreement with the City for maintenance of the water quality pond. 17. There shall be no outside storage on the premises, unless authorized by a Council approved conditional use permit. 18. Prior to issuance of the building permit, the applicant shall submit a revised utility plan that relocates the hydrant within the parking lot island, as approved by the Fire Inspector. 19. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. C. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. D. Compliance with the Ordinance regarding the location of fire hydrants, lock boxes, fire lanes, and fire lane signage. E. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. F. The City requires reproducible mylar prints of the sanitary sewer, water service, and storm sewer As-builts prior to releasing the financial guarantee. G. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07, 21030.06, and 21045.09 of the Zoning Ordinance.
