RESOLUTION 2002-134
RESOLUTION APPROVING A COOPERATION AGREEMENT WITH THE
METROPOLITAN COUNCIL FOR THE ACQUISITION AND OPERATION OF
RESIDENTIAL PROPERTIES IN CONJUNCTION WITH THE
METROPOLITAN COUNCIL'S FAMILY AFFORDABLE HOUSING
PROGRAM AND AUTHORIZING THE MAYOR AND CITY ADMINISTRATOR
TO EXECUTE THE COOPERATION AGREEMENT ON BEHALF OF THE
CITY.
WHEREAS, the Metropolitan Council is authorized by Minnesota Statutes section 473.195 to exercise
the functions, rights, duties, privileges, immunities and limitations as are provided for housing and
redevelopment authorities created for municipalities; and
WHEREAS, in conjunction with the implementation of its Family Affordable Housing Program
("FAHP"), the Metropolitan Council proposed to acquire and administer residential properties ("FAHP
Units") Nvithin the boundaries of the City, up to thirty percent of which units Nvill be made available to
eligible residents of the City; and
WHEREAS, Minnesota Statutes section 473.195, subdivision 1 requires the Metropolitan Council to
obtain the approval of the governing body of the City before the Metropolitan Council may implement its
proposed housing initiative Nvithin the boundaries of the City; and
WHEREAS, federal law requires the Metropolitan Council to enter into a Cooperation Agreement Nvith
the City in connection N ith the proposed acquisition and operation of the FAHP Units.
NOW THEREFORE, BE IT RESOLVED by the City Council that pursuant to Minnesota Statutes
section 473.195 the City Council gives its prior approval to the Metropolitan Council's proposal to
acquire and administer up to ten (10) FAHP Units Nvithin the boundaries of the City; and
BE IT FURTHER RESOLVED, by the City Council that the Mayor and the City Administrator are
authorized to execute the Cooperation Agreement on behalf of the City.
