APPROVING REVISION TO AGREEMENT
AT&T WIRELESS SERVICES OF MINNESOTA, INC.
LACOMPTE PARK MONOPOLE ANTENNA TOWER
WHEREAS, the City Council approved a lease agreement with AT&T Wireless Services of
Minnesota, Inc. on August 28, 2001 which provided for the location of a 75 foot monopole
antenna tower and equipment storage building on LaCompte Park property located at 10795
Old County Road 15; and
WHEREAS, the standard lease agreement form was used, including the fee of $60,000 as an
initial lump sum payment for the first five year term of the lease; and
WHEREAS, the City received a memorandum of lease and an agreement between the City
of Plymouth and AT&T Wireless Services of Minnesota, Inc. that were signed by AT&T
Wireless Services of Minnesota, Inc. officials; and
WHEREAS, the signed agreement did not contain a $31,000 credit toward the $60,000 lump
sum fee as verbally agreed to by City staff and AT&T Wireless Services of Minnesota, Inc.
representatives to cover the estimated cost of the lessee to constrict a 12' x 12' storage
building at LaCompte Park for the Park and Recreation Department; and
WHEREAS, documentation has been received indicating that the actual cost for the
constriction of the City storage building actually exceeds $31,000.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the Mayor and City Manager are authorized
to sign the revised agreement with AT&T Wireless Services of Minnesota, Inc. for the
LaCompte Park site located at 10795 Old County Road 15 which reflects a $31,000 credit to
AT&T Wireless Services of Minnesota, Inc. for the constriction of a 12' x 12' City Park
and Recreation storage building.
Adopted by the City Council on March 26, 2002.
