HomeMy WebLinkAboutCity Council Resolution 2002-131CITY OF PLYMOUTH RESOLUTION 2002-131 APPROVING A PRELIMINARY PLAT FOR TOMCAR, LLC, FOR 3 SINGLE FAMILY LOTS TO BE CALLED JORDAN'S RIDGE, FOR PROPERTY LOCATED AT 3785 BLACK OAKS LANE (2002004) WHEREAS, Tomcar, LLC has requested approval of a preliminary plat for 3 single family lots on a 1.4 -acre site located at 3785 Black Oaks Lane; and WHEREAS, the property is legally described as: The north two hundred eight and seven tenths (208.7) feet of the east two hundred eight and seven tenths (208.7) feet of the west half of the southwest quarter of the southeast quarter of Section seventeen (17), Township one hundred eighteen (118), Range twenty two (22), west of the fifth p.m. The south 81.5 feet of the east 208.7 feet of the west half of the northwest quarter of the southeast quarter of Section 17, Township 118, Range 22. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request Tomcar, LLC for approval of a preliminary plat for 3 lots on a 1.4 -acre site located at 3785 Black Oaks Lane, subject to the following conditions: Resolution 2002-131 (2002004) Page 2 1. The preliminary plat is approved in accordance with the plans received by the City on January 29, 2002, and February 8, 2002 and revisions received on February 12, 2002 and February 21, 2002, except as amended by this Resolution. 2. Any off site grading requires the permission of the adjacent property owner. Written proof of such permission shall be provided to the City either by letter or easement. The applicant shall resod the disturbed area. 3. The developer shall restore any portion of the trail along Dunkirk Lane that is damaged as a result of the development. The trail shall not be used for access or storage. 4. Upon submission of the final plat application, the applicant shall provide additional information on the rain garden and its related plantings, to demonstrate compliance with the City's Water Resources Management Plan. The rain garden is subject to City and Bassett Creek approval. 5. The applicant shall comply with the tree preservation regulations outlined in City Code. 6. All existing buildings must be removed prior to recording the final plat. A building permit will be required for demolition of the buildings. 7. Prior to recording the final plat, the developer shall pay the park dedication fees in lieu of land dedication, pursuant to the Dedication Policy in effect at the time of recording the final plat. 8. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Street names shall comply with the City Street Naming System. d. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. e. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. f. Location and number of fire hydrants shall be approved by the Fire Division. g. Submittal of fire flow data with the final plat. h. Submission of a Site Improvement Performance Agreement prior to issuance of building permits. i. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
