HomeMy WebLinkAboutCity Council Resolution 2002-108CITY OF PLYMOUTH RESOLUTION 2002-108 APPROVING CONDITIONAL USE PERMIT AMENDMENT FOR RELIANCE DEVELOPMENT COMPANY, LLP TO ALLOW 24-HOUR PER DAY OPERATION OF THE GAS/CONVENIENCE STORE LOCATED AT 4325 PEONY LANE (20004) WHEREAS, Reliance Development Company, LLP has requested approval of a conditional use permit amendment to allow 24-hour per day operation of the Gas/Convenience Store located at 4325 Poeny Lane, legally described as follows: Tract E, Registered Land Survey No. 187, Files of Registrar of Titles, County of Hennepin, except the southwesterly 112.5 feet thereof. Tract B, Registered Land Survey No. 1091, Files of Registrar of Titles, County of Hennepin, except that part thereof lying north of a line drawn from the most southerly corner of Tract A, said Registered Land Survey, to a point on the east line of said Tract B, distant 219.41 feet south from the northeast corner of said Tract A. That part of the east 33 feet of the east half of the northwest quarter of the northeast quarter of Section 18, Township 118, Range 22, lying southerly of the easterly extension of a line drawn from the most southerly corner of Tract A, Registered land Survey No. 1091, Files of Registrar of Titles, County of Hennepin, to a point on the east line of Tract B, said Registered Land Survey, distant 219.41 feet south from the northeast corner of said Tract A. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval of the conditional use permit amendment. Resolution 2002-108 (20004) Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Reliance Development Company, LLP for a conditional use permit amendment, subject to the following conditions: 1. This conditional use permit amendment approves 24-hour per day operation of the gas/convenience store located at 4325 Peony Lane, in accordance with the application received by the City on January 7, 2002, except as may be amended by this resolution. 2. Pursuant to Section 21455.07, Subd. 2 (i), the operation shall be responsible for litter control within 300 feet of the premises, and litter control is to occur on a daily basis. Trash receptacles must be provided on site at convenient locations to facilitate litter control. 3. Standard Conditions: a. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. b. This approval shall expire one year after the date of approval, unless the property owner or applicant has commenced the project or use, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
