HomeMy WebLinkAboutCity Council Resolution 2002-100CITY OF PLYMOUTH RESOLUTION 2002-100 FINDING THAT THE HIDDEN TERRACE TOWNHOME PROPOSAL BY SVK DEVELOPMENT, INC. IS EXEMPT FROM A DISCRETIONARY ENVIRONMENTAL ASSESSMENT WORKSHEEET (EAW) (2001107) WHEREAS, SVK Development, Inc. has submitted a preliminary plat application for Hidden Terrace Townhomes, a plat of 32 twinhome units on a ten -acre site located roughly 600 feet east of Fernbrook Lane on 46'1'Place North; and WHEREAS, the subject property is legally described as the east 10 acres of the north half of the southwest quarter of the southwest quarter of Section 10, Township 118 north, Range 22 west, Hennepin County, Minnesota. WHEREAS, on February 26, 2002, the State Environmental Quality Board (EQB) received a citizens petition for a discretionary Environmental Assessment Worksheet (EAW); and WHEREAS, the proposed project does not meet or exceed any of the thresholds specified in Minnesota Rules, Section 4410.4300 or 4410.4400; and WHEREAS, no part of the subject property is within a shoreland area, delineated flood plain, or state or federally designated wild and scenic rivers district; and WHEREAS, Minnesota Rules, Section 4410.4600, Subp. 12. A. (3) exempts the constriction of sewered residential developments with less than 40 units in a second class city from the Environmental Assessment Worksheet (EAW) requirements; and WHEREAS, the City of Plymouth is the Responsible Government Unit (RGU) for determining whether a proposed development is exempt from a discretionary Environment Assessment Worksheet (EAW). Resolution 2002-100 (2001107) Page 2 NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does find that the Hidden Terrace Townhome proposal by SVK Development, Inc. is exempt from a discretionary Environmental Assessment Worksheet.
