RESOLUTION NO. 2002-097
AUTHORIZING THE VACATION OF
THE UTILITY AND DRAINAGE EASEMENT FOR PONDING WITHIN
MISSION VIEW ADDITION
WIffiREAS, the property owners of Lots 5 and 6, Block 2, Mission View Addition, have received
approval at the February 12, 2002 City Council meeting of a lot division to create three lots; and
WI-IEREAS, a petition was received to vacate the utility and drainage easement for ponding within
Lots 5 and 6, Block 2, Mission View Addition; and
WI-IEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WI-IEREAS, a public hearing with respect to said vacation was scheduled for February 26, 2002, in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WIffiREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of February 26, 2002; and
WIffiREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WIffiREAS, the Council did hold a public hearing on February 26, 2002, to inform any and all
interested parties relevant to the vacation of the utility and drainage easement for ponding within Lots
5 and 6, Block 2, Mission View Addition; and
WI-IEREAS, it was determined by the City Council that said easements were not needed for public
purposes;

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following utility and drainage easement for ponding be
vacated, subject to the recording of the lot division referenced above:
All of the utility and drainage easement for ponding as dedicated in Lots 5 and 6, Block
2, Mission View, according to the recorded plat thereof, Hennepin County, Minnesota.
Adopted by the City Council on February 26, 2002.
