REQUEST FOR VARIANCE FROM RULES FOR STATE AID OPERATIONS
CHESHIRE LANE BRIDGE (MUNICIPAL STATE AID ROUTE NO. 164)
STATE AID PROJECT NO. 155-164-009
CITY PROJECT NO. 9006
WHEREAS, the City of Plymouth has State Aid constriction fiinds available from its 2001 allotment; and
WHEREAS, an anticipated project for the constriction of Cheshire Lane (State Aid Route No. 164) that was
anticipated to be constricted by the City was constricted as part of a developer improvement project; and
WHEREAS, the City did constrict the bridge over the CP Railroad to provide a separated crossing for the
roadway; and
WHEREAS, the plans for the constriction of the bridge had approval of the State Aid Bridge Engineer and
the State Bridge Engineer, but did not have approval from the State Aid Engineer; and
WHEREAS, State Aid Rule 8820.2800, Subpart 2, requires approval by the State Aid Engineer before
opening of bids to be eligible to receive State Aid constriction fiinds; and
WHEREAS, in order to receive State Aid constriction funds for the constriction of the bridge, a variance
must be granted in accordance with Rule 8820.3300; and
WHEREAS, the City believes that all constriction of the bridge was in accordance with State Aid riles
except for an approval before award of the Contract and there is State Aid constriction funds available in the
City of Plymouth's constriction account.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That a variance is requested from the Minnesota Rules of State Aid
Operations 8820.2800, Subpart 2, adopted pursuant to Minnesota Statutes Chapters 161 and 162, as they
apply to the constriction of the Cheshire Lane Bridge, known as Municipal State Aid Roadway 164,
State Aid Project No. 155-164-009, located approximately one-quarter mile west of I-494 and one-quarter
mile north of Schmidt Lake Road at the CP Railroad.
FURTHER BE IT RESOLVED: That the variance request is for receipt of State Aid fiinds that are from the
2001 constriction allocation to the City, but with Plan approval after the opening of bids.
