RESOLUTION 2002-060
APPROVING LOT DIVISION/CONSOLIDATION FOR LOUCKS ASSOCIATES FOR
LOTS 5 AND 6, BLOCK 2, MISSION VIEW (200112 1)
WHEREAS, an application has been filed by Loucks Associates which requests approval
of a lot division/consolidation to allow creation of one additional single-family lot for land
located south of Old Rockford Road and west of Forestview Lane; and
WHEREAS, the subject properties are presently legally described on Attachment One,
attached hereto and hereby made a part hereof, and
WHEREAS, the proposed lot arrangement for which the lot division/consolidation is
sought is as legally described on Attachment Two, attached hereto and hereby made a part
hereof.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
lot division/consolidation request by Loucks Associates subject to the following
conditions:
1. This lot division request is granted in accordance with the plans received by the City
on January 30, 2002, except as may be amended by this resolution.
2. Prior to filing the lot division with Hennepin County, the applicant shall submit
evidence of a recorded private easement allowing drainage from the subject site to
flow onto Mission Oaks First Addition.
3. Prior to filing the lot division with Hennepin County, the park dedication fee for one
additional residential dwelling unit shall be submitted to the City.
4. Prior to issuance of building permits, the lot division shall be recorded with Hennepin
County.

5. Compliance with the City's Tree Preservation Ordinance.
6. The applicant shall restore any portion of the trail along Old Rockford Road that is
damaged as a result of the development. The trail shall not be used for access or
storage.
7. After recording the lot division/consolidation, but prior to issuance of any building
permits, the applicant shall secure any necessary grading permits and shall complete
the grading operations for all affected parcels.
8. Standard Conditions:
a) Compliance with the City Engineer's Memorandum.
b) Removal of all hazardous trees from the property at the owner's expense.
c) Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new strictures on sites adjacent to, or containing any open storm water
drainage facility.
d) No variances are granted or implied.
e) Prior to filing the Lot Division with Hennepin County, submission of the
required utility and drainage easement documents, as approved by the City
Engineer.

North 88 degrees 48 minutes 30 seconds West, along the southerly line of said Lot 6, a
distance of 27.24 feet to the point of beginning of the line to be described; thence South
54 degrees 21 minutes 52 seconds West, a distance of 129.44 feet to the southwesterly
