RESOLUTION NO. 2002-042
RESOLUTION AUTHORIZING NEGOTIATIONS
FOR THE BUY-OUT OF THE SECTION 5310 TRANSIT VEHICLE
(PLYMOUTH FLYER) FROM MnDOT
WHEREAS, the City of Plymouth provides transit services pursuant to Minnesota Statutes
Section 473.388; and
WHEREAS, the City of Plymouth received a Section 5310 grant through MnDOT for the
purchase of a transit vehicle; and
WHEREAS, the City desires to terminate the Section 5310 program and negotiate a purchase
of the Section 5310 vehicle through established procedures as outlined by MnDOT; and
WHEREAS, Grant Agreement No. SG -01-080 has been approved by the Metropolitan
Council and the City for transit vehicle purchases; and
WHEREAS, the City Council has determined that it is in the best interests of the City to
terminate the Section 5310 program and to purchase the Section 5310 vehicle from MnDOT.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA:
1. That the City hereby adopts this resolution authorizing staff to negotiate a
buy-out agreement with MnDOT for the purchase of the Section 5310
transit vehicle known as the Plymouth Flyer and to terminate the Section
5310 program, and
2. That the City Council authorizes the Mayor and City manager to execute
the necessary agreement to implement this buy-out.
