RESOLUTION NO. 2003-583
REQUEST FOR FINAL PAYMENT
PLYMOUTH BLVD. MEDIAN IMPROVEMENTS
CITY PROJECT NO. 2003
WHEREAS, the City of Plymouth, as Owner, and F.M. Frattalone Excavating &
Grading, Inc., as Contractor, have entered into an agreement for the Plymouth Blvd.
Median Improvements, City Project #2003, said agreement being signed June 7, 2003;
and
WHEREAS, Close Landscape Architecture, as Consultant, has certified the acceptance of
the work and the approval of the final payment;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $175,154.50 and the value of work
completed to date is $197,058.50 and is herewith approved. The project does
exceed the contract amount.
2. That the work performed by the contractor for the Plymouth Blvd. Median
Improvements and certified to the Council by the architect as acceptable,
being the same, is hereby released from the contract except as to the
conditions of the performance bond, any and all legal rights of the owner,
required guarantees and correction of faulty work after final payment.
3. Request for Final Payment in the amount of $9,852.93 to F.M. Frattalone
Excavating & Grading, Inc. for the Plymouth Blvd. Median Improvements is
hereby approved and the City Finance Director is hereby authorized and
directed to pay the same forthwith.
Adopted by the City Council on December 16, 2003.
