HomeMy WebLinkAboutCity Council Resolution 2003-574CITY OF PLYMOUTH RESOLUTION 2003-574 APPROVING ENCROACHMENT AGREEMENT FOR A CULVERS RESTAURANT SIGN AT THE INTERSECTION OF STATE HIGHWAY 55 AND PEONY LANE WHEREAS, The owners of Culvers Restaurant and the property owner Peony 55 Partners, LLC have requested approval to execute an encroachment agreement to construct a sign within a drainage and utility easement; and WHEREAS, the encroachment agreement only permits the construction of the sign; and WHEREAS, the encroachment agreement only permits the encroachment sign and all related facilities must still meet all applicable City codes including the building code and zoning code; and WHEREAS, the City Council approved a variance to allow a 98 square foot free standing sign at this location on October 28, 2003; and WHEREAS, a condition of approval was that the applicant shall receive approval of an encroachment agreement from the City Council; and WHEREAS, the location of the sign shall be staked by a Registered Land Surveyor; and WHEREAS, the sign will be located at 4335 Peony Lane; NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign on behalf of the City of Plymouth an encroachment agreement that will allow for the construction of a 98 square foot free standing sign located within a drainage and utility easement at 4335 Peony Lane N. ADOPTED by the City Council this 16th day of December, 2003. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
