HomeMy WebLinkAboutCity Council Resolution 2003-570CITY OF PLYMOUTH RESOLUTION 2003-570 APPROVING A VARIANCE FOR A STORAGE SHED IN THE FRONT YARD FOR STEVE MOHN FOR PROPERTY LOCATED AT 10525 45TH AVENUE NORTH (2003122) WHEREAS, an application has been filed by Steve Mohn which requests approval of a variance for a 10 -foot by 12 -foot storage in the front yard for property legally described as follows: Lot 4, Block 1, Hamm Berg, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the variance request for a 10 -foot by 12 -foot storage in the front yard for property located at 10525 45th Avenue North, subject to the following findings and conditions: This variance request to permit a 10 -foot by 12 -foot storage shed in the front yard is hereby approved in accordance with the application and plans received by the City on November 3, 2003 and addition information on November 14, 2003, except as amended by this resolution. 2. The storage shed shall be finished to match the existing apartment and detached garage. This resolution is approved with the finding that the applicable variance standards have been met. Specifically: a) The parcel is long and narrow which limits the amount of side yard area for an accessory use. Resolution 2003-570 (2003122) Page 2 b) The conditions of the parcel are unique due to the shape of the lot being long and narrow. The lot also contains frontage on two public streets which is not typical. c) The request is not based exclusively upon a desire to increase value or income potential of the property. The proposed storage shed would allow the applicant to provide additional storage space for lawn and snow removal equipment to be used at the property. d) The hardship is caused by the Zoning Ordinance and is not self-created. The four -unit apartment was built in 1986; the current owners purchased the complex in 1993. The applicant did not choose the placement of the apartment on the lot. e) Granting the variance would not be detrimental to the public welfare or injurious to other and or improvements in the neighborhood. The proposed storage shed location would not be visible from Trenton Lane as it would be screened by an existing berm. The materials of the storage shed would meet or match the architecture of the existing apartment and detached garage. f) The variance would not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion of the public streets, or increase the danger of fire, or endanger the public safety, or substantially diminish or impair property values within the neighborhood. g) The variances would not impair an adequate supply of light and air to adjacent property, or substantially increase the congestion of the public streets, or increase the danger of fire, or endanger the public safety, or substantially diminish or impair property values within the neighborhood. h) The requested variance is the minimum action required to allow the applicant to provide additional storage space for lawn and snow removal equipment. 4. A building permit for the addition shall be obtained prior to construction. 5. This approval shall expire one year after the date of approval, unless the applicant has substantially started construction of the project, or unless the applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21030.06 of the Zoning Ordinance.
