HomeMy WebLinkAboutCity Council Resolution 2003-567CITY OF PLYMOUTH RESOLUTION 2003-567 APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR "BASS LAKE VILLAS" FOR LIFESTYLE PROPERTIES, INC. FOR PROPERTY LOCATED AT THE EAST OF TRENTON LANE AND SOUTH OF BASS LAKE ROAD (COUNTY ROAD 10). (2003004F) WHEREAS, Lifestyle Properties, Inc. has requested approval of a final plat for Bass Lake Villas, to allow the creation of 20 lots for 11 townhouses and seven single-family homes on the 8.24 -acre site located at east of Trenton Lane and south of Bass Lake Road (County Road 10); and WHEREAS, the property is legally described as follows: Outlot E, The Ponds at Bass Creek, according to the recorded plat thereof, Hennepin County, Minnesota WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Lifestyle Properties, Inc. for a final plat for Bass Lake Villas; and FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. This final plat approves 20 lots including seven single-family lots, 11 unit lots, and two outlots in accordance with the plans received by the City on October 27, 2003 and November 12, 2003, except as may be amended by this Resolution. Resolution 2003-567 (2003004F) Page 2 2. Prior to recording the final plat, the applicant shall submit a 10 -foot trail easement adjacent to Bass Lake Road across the entire property. 3. Prior to recording the final plat, the applicant shall submit the required pond maintenance agreement between the developer and the City. 4. Prior to recording the final plat, the applicant shall submit the required cross -access agreements to allow the exception property access to Trenton Lane via the private drive. 5. Prior to recording the final plat, the applicant shall submit the required cross -access agreements to allow Lot 1, Block 3 to access Trenton Lane across Lot 2, Block 3. 6. Prior to recording the final plat, the developer shall pay the park dedication fees, pursuant to City Code at the time the final plat is approved, for the total number of units shown on the plans. 7. Prior to issuance of building permits, the applicant shall submit a revised landscaping plan that relocates the trees currently shown over utility lines. The revised landscaping plan shall also include a row of large evergreen trees along the southern lot line of Lot 7, Block 3 to provide a screen to the adjacent lot in the Ponds at Bass Creek development. 8. Prior to issuance of building permits, the applicant shall revise the grading plan to include wetland buffer monuments on the north side of the creek at the property line on the west side and 60 feet from the edge of the delineated wetland on the east side. 9. Prior to issuance of building permits, the applicant must install the required permanent wetland buffer monuments pursuant to ordinance requirements. 10. Prior to the issuance of building permits, the applicant shall revise the plans to show the fire lane turnaround 120 feet long, measured from inside of curb. 11. The HOA shall be responsible for maintenance of the private drive (at 100 percent until such time as the exception property develops), sidewalks, boulevard plantings, wetland buffers, mailboxes, monument signs and association common areas within this development. The HOA documents shall include language to address maintenance of these features. 12. Lot 1, Block 4 shall be considered unbuildable until such time as it is combined with property to the east that has street access. 13. The streetlight shall be substantially similar to those used in the Harrison Hills subdivision to the west. The applicant is encouraged to install the streetlight prior to occupancy of the units. Resolution 2003-567 (2003004F) Page 3 14. All townhouse units, Blocks 1 and 2, shall be protected with a City approved automatic fire sprinkler system. 15. The applicant is encouraged to work with staff to make a portion of the development affordable or accessible to first-time homebuyers. 16. Development standards shall be as required by the RMF -2 and RSF-3 districts. 17. No access to Bass Lake Road shall be permitted. 18. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. With the exception of one building permit for a model home, no building permits shall be issued until the final plat is filed and recorded with Hennepin County. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. No building permits shall be issued until a contract has been awarded for sewer and water. f. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. g. Prior to issuance of any building or utility permits, the applicant shall submit fire flow calculations in compliance with City Code and other applicable codes. h. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release of any site improvement financial guarantees per City Policy. i. Prior to issuance of building permits, the applicant shall revise plans identify the domestic size of the combination fire/domestic water supply line, supply a PIV valve and siamese connection if required, and show fire lane, address and directional signs in approved locations. j. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility.
