HomeMy WebLinkAboutCity Council Resolution 2003-554CITY OF PLYMOUTH RESOLUTION 2003-554 APPROVING A SITE PLAN AND VARIANCES FOR QUEST REAL ESTATE, INC. FOR CONSTRUCTION OF THE "WOODS AT MEDICINE LAKE," A 26 -UNIT TOWNHOUSE DEVELOPMENT LOCATED EAST EAST OF SOUTH SHORE DRIVE AND 200 FEET NORTH OF 11TH AVENUE NORTH (2003089) WHEREAS, Quest Real Estate, Inc. has requested approval of a site plan and variances to allow construction of a 26 -unit townhouse development on property legally described as follows: All that part of the North 50 rods of the Northwest quarter of the Northwest quarter lying East of the Center line of County Road No. 70 and lying south of the North 316 feet thereof in Section 36, Township 118, Range 22, Hennepin County, Minnesota, according to the United States Government Survey thereof. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval of the site plan; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Quest Real Estate, Inc. for a site plan and variances for the "Woods at Medicine Lake," a 26 -unit townhouse development located east of South Shore Drive and 200 feet north of 11th Avenue North, subject to the following findings and conditions: A site plan is approved to allow construction of a 26 -unit townhouse development, in accordance with the plans received by the City on November 12, 2003, except as amended by this resolution. 2. Approval of the site plan is contingent upon City approval of the wetland replacement plan and the preliminary plat. Variances to 1) allow private drives over 300 feet in length without a continuous connection or loop to a public street, 2) waive the requirement for a fire -lane turnaround on private Resolution 2003-554 Site Plan (2003089) Page 2 drives over 150 feet in length and 3) waive the requirement for a fire lane within 150 feet of all sides of all buildings based upon the finding that the applicable variance standards as listed in Section 21030.03 of the Zoning Ordinance have been met and subject to the following conditions: a. All buildings shall be protected by a monitored, automatic fire sprinkler system. b. A looped water system shall be provided throughout the site. c. Fire hydrants be installed in approved locations throughout the site. d. As part of the final plat application, the applicant shall submit fire flow calculations in compliance with City Code. 4. As part of the final plat application, the applicant shall submit a lighting plan showing all lighting proposed on the property in conformance with the Zoning Ordinance as well as the location of all street lights in the public rights-of-way in conformance with the Subdivision Ordinance. 5. As part of the final plat application, the applicant shall provide the city with revised plans that show the private drives reduced to 20 to 22 feet in width. 6. As part of the final plat application, the applicant shall provide the City with a revised landscaping plan in conformance with the Zoning Ordinance, specifically demonstrating the following information: a. Sod shall be installed in all the disturbed areas outside the wetland buffer with the exception of the water -quality pond. b. Screening is required to be installed between the guest parking spaces and the adjacent single-family homes. c. An appropriate seed mixture as defined by the Zoning Ordinance shall be substituted for the turf mixture within the wetland buffer areas. d. Small interpretive signs shall be installed along the woodchip trail. 7. The applicant is encouraged to work with staff to make a portion of the development affordable. 8. Development standards shall be as required by the RMF -2 districts. Except the variances specified in this resolution, no other variances are granted or implied. 9. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d. Signs shall require separate permits prior to installation. Resolution 2003-554 Site Plan (2003089) Page 3 e. All structures shall be protected by a City approved automotive fire sprinkler system and monitored as required. f. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement financial guarantees per City Policy. g. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. h. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07 and 21045.09 of the Zoning Ordinance ADOPTED by the City Council on November 25, 2003.
