RESOLUTION NO. 2003-550
AUTHORIZING THE VACATION OF A
DRAINAGE AND UTILITY EASEMENT WITHIN
LOT 1, BLOCK 1
ANNICK ACRES
WHEREAS, a petition was received to vacate part of a drainage and utility easement within Lot 1,
Block 1, Annick Acres; and
WHEREAS, this request was made by the owner of the land abutting the area proposed to be vacated;
and
WHEREAS, a public hearing with respect to said vacation was scheduled for November 25, 2003 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of November 25; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on November 25, 2003 to inform any and all
interested parties relevant to the vacation of a drainage and utility easement within Lot 1, Block 1,
Annick Acres; and
WHEREAS, it was determined by the City Council that said easement was not needed for public
purposes;

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following drainage and utility easement be vacated:
The easements for drainage and utility purposes within Lot 1, Block 1, as dedicated in the plat
of Annick Acres, according to the recorded plat thereof and situate in Hennepin County,
Minnesota, except the easterly 10 feet, the east 6 feet of the south 100.00 feet and the south 6
feet of the east 110.00 feet.
Adopted by the City Council on November 25, 2003.
