RESOLUTION NO. 2003-510
ACCEPTING THE STREET CONSTRUCTION
PLUM TREE EAST 6TH ADDITION (2001015)
WHEREAS, in accordance with the development contract dated April 11, 2001,
Lundgren Bros. Construction, Inc., developer of Plum Tree East 6th Addition (2001015),
has agreed to install certain improvements for said development; and
WHEREAS, the developer has requested that the City accept the street for continual
maintenance; and
WHEREAS, project engineer has certified that the improvements were constructed in
accordance with the approved plans and specifications; and
WHEREAS, developer has requested a letter of credit be used in lieu of a maintenance
bond and has provided a letter of credit in the amount of 20% of the cost of the
improvements;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA; that the street construction is accepted for
continual maintenance as of November 10, 2003 subject to the one year guarantee by the
Developer per Letter of Credit #FGAC-01072 in the amount of $11,420 which is 20% of
the construction cost.
